Actos Caused Bladder Cancer After Eight Years on the Drug Alleges Lawsuit

Actos Pills Cause Bladder Cancer Allege LawsuitsRalph Penrod, of Hartford City, Indiana, is the latest plaintiff to join the Actos multidistrict litigation (MDL) in Louisiana. Ralph states in his Actos lawsuit that he took the type 2 diabetes treatment drug for eight years after being prescribed Actos in 2003. In April of 2011 Ralph stopped taking Actos after suspecting he came down with bladder cancer. Ralph underwent surgery to treat his allegedly Actos related bladder cancer and tumors in August of 2011.
Ralph’s Actos bladder cancer joins the MDL filed in Lousiana. The MDL allows thousands of Actos users to file similar lawsuits under one umbrella but maintain individuality so they receive their own award once the case is won or settled. The Actos MDL is similar to an Actos bladder cancer class action lawsuit but different in that one key aspect. In an Actos bladder cancer class action lawsuit thousands of Actos users are joined together but if the Actos class action lawsuit settles they typically share the award. Everyone who joins the Actos MDL will receive any financial award individually unlike an Actos class action lawsuit.
Ralph’s Actos bladder tumor lawsuit states that he suffered “severe mental and physical suffering, mental anguish, emotional distress, incurred medical expenses and living related expenses.” Like many Actos bladder tumor lawsuits Ralph’s suing to get compensated for all of his expenses as well as punitive damages for his suffering and pain. Ralph’s Actos bladder cancer lawsuit also states that Takeda Pharmaceuticals didn’t appropriately or adequately warn users of Actos, or their prescribing physicians, of the severe side effects of Actos which includes bladder cancer and cardiovascular problems. Ralph states that he and his physician may not have decided to use Actos if they were aware of the risk of developing bladder cancer.
Actos users should be aware of the symptoms of bladder cancer. Typical bladder cancer symptoms include tumors which may cause blood in the urine, painful or frequent urination, or straining during urination. In addition, other common signs of bladder cancer include fatigue, incontinence, weight loss and bone pain or tenderness. In addition, in cases where the patient taking Actos develops bladder cancer or tumors survives, the spouse may be able to file a lawsuit alleging “loss of consortium”, even though the spouse thankfully didn’t die due to their injuries from Actos. Ralph’s lawsuit doesn’t include mention of whether his spouse (if he has one) is suing Takeda Pharmaceuticals for “loss of consortium.”
