BMW diesel emissions scandal traffic jamA class action lawsuit has been filed against luxury automobile company BMW and supplier Robert Bosch GmbH, alleging that BMW diesel emissions are as much as 27 times than the legal limit.

The BMW diesel emissions scandal has already gained legal traction, with several California drivers filing a collective lawsuit. More specifically, BMW AG has been added to a growing list of car companies being sued by consumers who own BMW vehicles affected by the BMW diesel emissions scandal.

The cars in question reportedly had certain software programs implemented, which were designed to give a false reading in diesel emissions tests. Also known as a defeat device, this software allegedly senses when the vehicles are in testing environments and are programmed to emit the appropriate amount of emissions levels to enter the market.

Also named in the California BMW diesel emissions lawsuit is Robert Bosch GmbH, which is the company allegedly responsible for installing the software designed to cheat emissions tests. The algorithms used in the software is reportedly similar to what was used in the Volkswagen diesel emissions scandal, which also produced emissions much higher than what EPA allowed.

“At these levels, these cars aren’t just dirty — they don’t meet standards to be legally driven on U.S. streets and no one would have bought these cars if BMW had told the truth,” an attorney involved in the BMW diesel emissions scandal lawsuit stated.

The BMW diesel emissions scandal affects thousands of 2009 to 2011 BMW X5 and 335D diesel vehicles, which the plaintiffs claim gave false readings to pass federal standards set by the Environmental Protection Agency (EPA) and to trick consumers into paying higher prices for these vehicles.

Overview of Diesel Emissions Scandal

BMW allegedly admitted to the diesel emissions scandal in February 2018, with the company stating it had accidentally implemented the wrong software in nearly 12,000 diesel vehicles.

BMW had recently contacted Germany’s Federal Motor Transport Authority, after internal tests had shown that thousands of cars had the diesel emissions cheating software. After news of this diesel emissions broke to the public, BMW has repeatedly described this incident as a mistake and was “not a targeted manipulation of emissions controls.”

However, the BMW diesel emissions lawsuit alleges emissions cheating software was intentional, with the company allegedly working with Bosch to develop a method to meet EPA requirements and exaggerating their vehicle’s performance to entice consumers.

Essentially, BMW allegedly had been over ambitious with sales goals in the United States diesel market, but had reportedly found it “impossible to achieve their goals lawfully” and had worked with Bosch to create the diesel emissions scam.

It is important to note that Bosch has been linked to other car companies with defeat devices, which includes Volkswagen and its Audi and Porsche brands. These car companies faced accusations of working with Bosch for almost 20 years, by allegedly limiting technology in their vehicles while beating out the competition.

The BMW diesel emissions lawsuit is accusing the luxury car brand of numerous counts of fraud, including racketeering, corruption, and unfair business practices throughout the United States.

    So what Happens now to my BMW X5 Diesel, if it doesn’t pass US Requirements? Would I still be allowed to drive my truck? I can’t afford a new car that’s for sure, since my BMW is always in service. And now I just found out that I need to fix some sensor problems ( its over 11k in repair) that is allowing me to have a very bumpy ride on the road…. DUMB! And yes my Truck Constantly failed Smog Checks back to back then finally after 6x my Smog test got Waved.
