  • Why: Tarr claims StubHub violated the Americans with Disabilities Act by failing to make its website fully accessible to and independently usable by individuals who are blind or visually impaired.
  • Where: The class action lawsuit was filed in New York federal court.

StubHub failed to design and operate its website in a way that would make it fully accessible to and independently usable by individuals who are blind or visually impaired, a new class action lawsuit alleges.

Plaintiff Ellen Elizabeth Tarr’s class action lawsuit claims StubHub’s website contains access barriers to screen-reading software individuals who are blind and visually impaired to access the internet use.

Tarr, who is legally blind, argues the alleged access barriers deny individuals who are blind or visually impaired equal access to the goods and services offered on StubHub’s website.

“Stubhub.com contains significant access barriers that make it difficult if not impossible for blind and visually impaired customers to use the website,” the StubHub class action states.

Tarr wants to represent a nationwide class and New York subclass of legally blind individuals who were denied equal access to the enjoyment of goods and services offered on StubHub’s website.

Class action claims StubHub website contains access barriers to screen-reading software

Access barriers to screen-reading software found on StubHub’s website includes a lack of alt text, ambiguous link texts, unclear labels for interactive elements and inaccessible drop-down menus, among other things, according to the StubHub class action.

“StubHub denies the blind access to goods, services and information made available through Stubhub.com by preventing them from freely navigating Stubhub.com,” the StubHub class action states.

Tarr claims StubHub is guilty of violating the Americans with Disabilities Act, New York State Human Rights Law, New York State Civil Rights Law and New York City Human Rights Law

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory and statutory damages for herself and all class members.

StubHub previously agreed to a settlement that ended claims the company violated California law with the way it displayed ticket fees on its website.
