Klondike website class action lawsuit overview: 

  • Who: Valerie Dicks filed a class action lawsuit against Unilever United States, Inc. 
  • Why: Dicks claims parent company Unilever failed to design and maintain its klondikebar.com website so that it is fully accessible to individuals who are blind or visually impaired. 
  • Where: The class action lawsuit was filed in New York federal court. 

Unilever has failed to design and maintain a website that is fully accessible to individuals who are blind or visually impaired, a new class action lawsuit alleges. 

Plaintiff Valerie Dicks claims Unilever denies individuals who are blind or visually impaired equal access to the goods and services offered on its klondikebar.com website. 

Dicks argues that klondikebar.com has “significant access barriers” that make it “difficult if not impossible” for blind and visually impaired individuals to use the website or make a transaction on it. 

“By failing to make the website accessible to blind persons, Defendant is violating basic equal access requirements under both state and federal law,” the Klondike class action states. 

Klondike class action claims website not compatible with screen-reading software

Dicks claims Unilever’s klondikebar.com website is not compatible with screen-reading software used by herself and other blind and visually impaired individuals to browse the internet. 

The Klondike website’s access barriers to screen-reading software include inaccessible contact information, keyboard trap, inaccurate landing structure and lack of alt text on graphics, among other things, according to the Klondike class action. 

“Klondikebar.com contains access barriers that prevent free and full use by Plaintiff and blind persons using keyboards and screen-reading software,” the Klondike class action states. 

Dicks claims Unilever violates New York City Human Rights Law, New York State Civil Rights Law and the Americans with Disabilities Act

Plaintiff demands a jury trial and requests declaratory and injunctive relief along with an award of compensatory and statutory damages for herself and all class members. 

Dicks wants to represent a nationwide class and New York subclass of individuals who are blind or visually impaired and have been denied access to the enjoyment of goods and services offered on klondikebar.com. 

In related Unilever news, the company issued a voluntary recall in March for two of its Suave 24-Hour Protection Aerosol Antiperspirants after an internal review showed they contained an elevated level of Benzene, a known human carcinogen.
