A deal has been reached in a class action lawsuit against Dollar General alleging violations of the Americans with Disabilities Act.

Dollar General must keep its stores’ aisles clear of clutter so that people in wheelchairs can move around without difficulty, according to a proposed class action settlement agreement.

Rebecca Nocera, the lead plaintiff, filed a class action lawsuit against Dollar General in 2018, arguing shoppers in wheelchairs were unable to navigate stores because they were blocked with merchandise.

In the settlement agreement, Dollar General says they’ll work to keep aisles free from boxes and unshelved products moving forward, along with better staff training. 

Part of the deal also means Dollar General will be setting up a hotline for consumers to call if future violations occur, according to the filing, posted clearly at store entrances. Dollar General will be including accessibility checks during quarterly inspections, according to the settlement. 

Dollar General also agrees to having attorneys for the proposed class conduct surprise inspections to check for compliance. 

Dollar General initially fought the class action lawsuit and wanted it dismissed in 2019. 

In a motion filed in 2018, the discount retailer argued the blocking of aisles was only temporary and eventually was cleared. The judge rejected the motion on the grounds it didn’t relate to the initial complaint’s claims. 

The case was later merged with two other lawsuits against Dollar General with ADA violation allegations, according to Law360

Negotiations on the settlement began in Feb. 2020 and eventually resulted in this current deal. 

Dollar General doesn’t admit to any wrongdoing with this settlement and will payout no money to class members, but lead plaintiffs will be awarded $1,000 each. 

In the proposed deal, Dollar General will publish details on the settlement on a website dedicated to the lawsuit. The company will also be sending notices of their plan to keep stores ADA compliant to organizations serving the interests of people with disabilities.

    I worked for DG I was diagnosed with a terminal cancer! I took fmla cause of a stem cell transplant came back after 90 days and was fired 3 months. I BELIEVE IT WAS BECAUSE OF MY CANCER, THE DM KNEW I HAD CHEMO BRAIN WHICH I WOULD FORGET THINGS. I THINK I DO HAVE A CASE AND I WILL KEEP PUSHING.

    I am disabled and can only walk so far. With that being said I need a wheelchair to assist in going through any store to get necessities that I need at a affordable price. I can Not do this at any Dollar General because they DO NOT have Wheelchairs or the motorized carts for the disabled customers. I feel this is a Major Concern under the disability act.

    All the Dollar stores in my area are crowded with carts of items to be put away. I use a cane to walk with and cannot carry anything and am never able to shop in any of our Dollar stores because i cant push a cart down any isle. There is not enough room. My rights as a disabled human have been violated. How does this company keep getting away with not having enough help so the managers say , all the while i never see the majority trying to do anything because they are not at the register they are watching for theives because nothing gets put away. I like to shop there but they have to be held accountable. Other bussiness are held accountable so why do they not? I think i may start staking pictures and posting from every one I go in and post on social media till they are held liable.

    I have 3 kids that are mentality disabled from birth they did not do anything despite being born into this world no one respects a person who is disabled mentally they’re struggle, their continuous fight to be accepted is above our own human intelligence but this fight for peopele who have disabilities is everywhere
    in the Courtroom I’ve seen people be sentenced who dont understand what is happening to them ADA where is the help firbthe most
    Vunerable dozens of innocent people sit behind bars because they said what court and people who violated the ADA compliance it has been devastating and no one is saying Anything these people are crushed by eager men and people who want to get a pat on the back convicting mebtally disabled people after the very own law abiding citizens take the law into theirvown hands Its called Abuse of power from helpless people whose disability is mental where is the compliant also the abuse of power even in the dollar General it s another battle as one of my sons and I were kicked out because he has a mental handicap and pit a Hulu card for me to pay for we could not afford itso the manager said don’t come back you have to find somewhere else to shop because all I had was foodstampsvi was notvalowe to even use my foodstamp card but was told to leave because I am a single motherbi was discriminate d against and my son being men rally handicapped this I can never for get tjs one along with the struggles to defend my children and yo protect them from bloodthirsty people who say the are the law but don’t respect it for others.

    As a current employee I can tell you this is getting worse. We are over staffed but not given the payroll to bring people in. Single coverage all the time with one person (manager) expected to do everything.

    I am dissabled. I cannot walk more than 20 feet. I use a gmhandicap plaque. I am leagly blind have panic attacks and all my disc ate gone in my back.
    Its got so bad at my local dollar general that i cannoy shop. I get very frustrated and has got to the pount that i usually call just to ask the situation of the store
