Ikon Pass agreed to a class action lawsuit settlement to resolve claims it failed to issue refunds for yearly passes after resorts closed because of COVID-19.

The settlement benefits American consumers who purchased or received as a gift an Ikon Pass resort pass for the 2019/2020 season and who used their pass on one or more days before March 15, 2020.

Ikon Pass is a ski and snowboard resort company with over 50 destinations around the world. In the United States, Ikon Pass has locations in Colorado, New Mexico, California, Oregon, Washington, Maine and more.

According to a class action lawsuit against Ikon Pass, the resort operator failed to refund customers for “unlimited” season passes when resorts closed due to the COVID-19 outbreak in 2020. The plaintiff in the case says that he paid hundreds of dollars for unlimited access that promised “no blackout dates.”

Although no one could predict the COVID-19 outbreak, the class action lawsuit argued that Ikon Pass still had a responsibility to issue refunds to customers who did not get the full benefit of their season pass purchases. 

The plaintiff argues Ikon Pass and resort operator Alterra laid off most of their resort employees, meaning they could easily afford to refund customers due to decreased operating costs.

Ikon Pass hasn’t admitted any wrongdoing but agreed to a class action settlement to resolve these allegations. The exact settlement amount is not disclosed in court documents.

Under the terms of the settlement, class members can receive either a pass credit or a lift product voucher. 

Pass credits can be used towards the purchase of a 2023/2024 or 2024/2025 Ikon Pass season pass. Lift product vouchers can be used towards the purchase of a single-day lift ticket at any Alterra resort on or before July 31, 2025.

Voucher values will vary depending on the number of days class members used their 2019/2020 Ikon Pass. 

High-value pass credits of $150 will go to class members who used their Ikon Pass resort pass only one day during the season. From there, class members will receive a $125 credit for two days of use, a $100 credit for three days of use, a $50 credit for four days of use, $20 for five or six days of use and smaller payments of $10 for seven or more days of use.

Lift product vouchers will be distributed similarly. Class members who used their pass for one day can elect to receive a voucher for 50% off. Vouchers will decrease in value as the number of days increases, with class members receiving a 40%-off voucher for two days, a 30%-off voucher for three days, a 25%-off voucher for four days and a 20%-off voucher for five or more days.

The deadline for exclusion and objection is Nov. 18, 2022. 

The final approval hearing for the Ikon Pass COVID-19 refunds settlement is scheduled for Jan. 19, 2023.

In order to receive settlement benefits, class members must submit a valid claim form by Jan. 2, 2023.
