The federal government has taken Natural Solutions Foundation and two of its top executives to court to stop them from selling “nano silver” solution as a purported coronavirus treatment.

Natural Solutions has been marketing its nano silver product as being capable of everything from preventing COVID-19 infection to curing those already infected with it, and everything in between — none of which has been scientifically proven true, lawyers for the government say. The company was first warned by the U.S. Food and Drug Administration (FDA) to stop making the false claims in May, but it continued doing so, at least in part, according to the administration.

Lawyers from the U.S. Department of Justice, Department of Health and Human Services and the FDA filed for an injunction in federal court in New Jersey on Nov. 13 against Natural Solutions; its medical director, Dr. Rima Laibow; and its vice president of legal affairs, Ralph Fucetola. The government wants a federal judge to order Natural Solutions to stop advertising its “Dr. Rima Recommends Nano Silver 10PPM” as a coronavirus cure.

Natural Solutions has stopped selling the product, and a message on the company’s website says the Justice Department sent it a “cease and desist” order Sept. 8, which it is honoring. The message to customers says Natural Solutions is defending itself: “Rest assured, our legal challenge is under way!”

Nano silver is a solution in which nanoscale silver particles are suspended in liquid. It is also referred to as colloidal silver and has been sold as a dietary supplement and alternative medicine for the treatment of many illnesses.

Natural Solutions held the product out as a drug, which makes it subject to strict regulations and approval guidelines under U.S. law — and the company violated that law, the Justice Department is arguing.

Essentially, the company was marketing and selling an unapproved drug to treat COVID-19 and as a coronavirus cure, the government’s request for an injunction says.

In a press release issued last week, Acting Assistant Attorney General Jeffrey Bossert Clark of the Justice Department’s Civil Division said the case should be considered a warning to other companies defying FDA warnings.

“The Department of Justice will not allow individuals to take advantage of the ongoing public health emergency by peddling unproven, unapproved drugs,” he said. “We will continue to work closely with the Food and Drug Administration to halt the illegal sale of such products during this pandemic.”

Since the coronavirus pandemic began, the FDA has issued dozens of warnings to companies across the nation found to be advertising and selling products as COVID-19 treatments, cures or preventatives without the scientific backing to support their claims.

In a related case, a federal court in Oklahoma in May issued a temporary restraining order, and later a preliminary injunction, against the company behind N-Ergetics to stop it from selling a colloidal silver product it also claimed was a coronavirus cure.

Stacy Amin, chief counsel at the FDA, said companies that violate the law by making unproven claims about their unapproved treatments for COVID-19 and “despite warning, failed to take prompt voluntary action to sufficiently correct their conduct, place unsuspecting American consumers at risk.”
