Plaintiffs in the belVita class action lawsuit claim that Mondelēz International Inc. violated consumer protection laws with false labeling. belVita packaging claims allegedly mislead consumers into believing that the products are healthy despite high levels of added sugar. The plaintiffs say they were deceived into paying a higher price for belVita products based on these marketing claims.

Open for Claims

Mondelēz agreed to pay $8 million to resolve the claims surrounding its belVita products. The deal provides injunctive relief in the form of updated package claims which exclude the words “nutritious,” “healthy,” “balanced,” or “wholesome.” The settlement also provides monetary relief in the form of cash payments.

Under the settlement, eligible Class Members can recover cash payments estimated to be $34.10. Exact payments will vary depending on the net settlement fund after cost and fees deductions. Payments will be proportional to the number and cost of products purchased by Class Members.

To receive a higher payment, Class Members must provide proof of purchase. Without a receipt or other form of proof, consumers can only claim 2 products per month of belVita purchases. Claims that include proof of purchase are not subjected to these limitations.

Class Members have until Feb. 9, 2022, to exclude themselves from or object to the settlement.

belVita purchasers must file a valid claim form by Feb. 9, 2022, in order to benefit from the settlement.
