Update from the President of TCA

Wow! Didn’t I say it was getting cooler? It IS getting more comfortable at night but it’s still tickling 110 in Phoenix! Ugh!

We’ve seen some interesting case developments over the past few weeks. A court ruled that Oracle has to pay business travelers overtime when they’re in California, even if they’re not FROM California. This is a big change because typically you are paid based on the laws of the state you reside in, NOT, the state the business is based. We’re expecting a flurry of lawsuits against other California based businesses that weren’t paying out of state employees for overtime in the coming months. If it happened to you let us know. We work with the best, shouldn’t you?

Another interesting case is the Dollar Tree Store Manager Unpaid Overtime class action lawsuit was decertified. That means it lost class action status. This is a direct result of the Dukes v Wal-Mart decision handed down by the Supreme Court. It will be much harder to get employment class action lawsuit certified going forward and we expect to see many that were already certified to be thrown out in the years to come. It doesn’t mean we won’t see employment class actions anymore it just means that the class has to be really well defined and suffered similar financial injuries.

One final case note. Classmates.com upped the ante in their settlement. Now class members can receive up to $15 instead of $3. It pays to let your voice be heard!
