  Judge Approves False Ad Jamba Juice Class Action Settlement
A California federal judge has given preliminary approval to a class action settlement alleging Jamba Juice Smoothie Kits are mislabeled as “all natural.” The false advertising class action lawsuit alleged the Jamba Juice Smoothie Kits included ingredients such as xanthum gum and gelatin, which are not considered natural. If you purchased a Jamba Juice Smoothie Kit, your rights may be affected by this class action settlement.

 

Minn. Farmer Files Syngenta Corn GMO Class Action LawsuitSyngenta has been hit with another class action lawsuit alleging it caused significant damage and financial loss to U.S. farmers by contaminating corn crops with genetically modified corn. The GMO corn class action lawsuit alleges Syngenta’s release of Agrisure Viptera into the U.S. corn seed supply destroyed the export of corn to China and depressed the prices of all domestic corn. If you, a family member, partner or associate has been affected by Syngenta GMO corn or declining corn prices, you may be eligible for compensation.

 

Excelsior College Nursing Program Class Action Settlement  – Excelsior College has reached a class action settlement with a group of current and former nursing students who allege the college’s distance learning nursing program did not prepare them to pass the final nursing exam. If you were a nursing student at Excelsior College and failed the college’s Clinical Performance in Nursing Examination (CPNE) more than once, you may be able to claim $200 for each CPNE test failure if the class action settlement is approved. Quinolones May Lead to Peripheral Neuropathy Side EffectsA recent study found that people who take quinolone antibiotics were more likely to develop painful peripheral neuropathy, a condition that affects the peripheral nervous system. Symptoms of peripheral neuropathy may include tingling or numbness in the hands or feet, sharp or burning pain, extreme sensitivity to touch, muscle weakness, lightheadedness or dizziness. FTC: American Tax Relief, AdvaCAL, L’Occitane Refund Checks in the MailThe Federal Trade Commission is mailing checks to consumers who purchased AdvaCAL calcium supplements, L’Occitane “slimming” supplements, and/or services from American Tax Relief. If you purchased any of these products or services, keep an eye on your mailbox, as you may soon be receiving a refund check. Note that these checks expire, so be sure to cash them soon!

 

Benicar Lawsuit Filed After Woman Suffers Side EffectsA Benicar lawsuit accuses drug makers Daiichi Sankyo and Forest Laboratories of failing to warn about the dangers of serious injuries associated with the blood pressure drug. The plaintiff alleges she suffered sprue-like enteropathy, a condition that leads to severe diarrhea, nausea and abdominal pain, after taking Benicar. BMW Cracked Wheel Class Action Settlement Gets Initial OKA federal judge has preliminarily approved a class action settlement that will resolve allegations BMW of North America LLC knowingly sold BMW Z4 vehicles containing defective alloy wheels. Under the terms of the BMW class action settlement, BMW will pay for or reimburse eligible Class Members for the cost of repairing the cracked alloy wheels.

 

4 Risperdal Lawsuits Allege Adolescent Male Breast Growth Four young men recently filed Risperdal lawsuits against Johnson & Johnson and its subsidiary Janssen Pharmaceuticals alleging they developed gynecomastia (male breast growth) as a result of taking the antipsychotic medication. The plaintiffs allege J&J and Janssen made false and misleading claims about the risks associated with Risperdal. There are currently more than 420 Risperdal lawsuits pending in federal and state courts throughout the country.

 

Class Member Objects to eBay Listing Fee Class Action SettlementA Class Member has objected to a $6.4 million class action settlement with eBay Inc., arguing that it is unfair because it prevents those who do not opt out from filing future class action lawsuits against eBay and will allow the online marketplace to escape a potentially larger settlement in a separate class action lawsuit that is currently pending.

 

FDA Warns Against Infuse Bone Graft System in ChildrenThe U.S. Food and Drug Administration has issued a new Safety Communication to health care professionals, reminding them that the Infuse Bone Graft System is not intended for use in children under the age of 18 because it was not tested on children and their developing bones may react unpredictably to the bio-engineered gel. If you or a loved one were implanted with Medtronic’s Infuse bone graft and suffered complications, you may have a legal claim.

Update from the President of TCA

 

Hello Awesome Top Class Actions readers! I hope you had a great week! We’re busy talking to some of the largest class action firms in the country. You’ll see a lot more from us soon. In fact I spoke with one attorney on Monday who wants us to be a part of his plaintiff focused class action seminar. He dedicates 15 – 30 minutes of each seminar to talk about Top Class Actions and thinks it would be even better if we were there in person to answer questions on what we do, who we help, how we help, and what we’ve got planned. That’s pretty awesome! It’s great that these consumer-focused law firms are tracking me down instead of the other way around.

 

I remember 6 – 7 years ago sponsoring conferences and getting that blank look when I told attorneys about Top Class Actions. They had no idea who we were. Now we don’t have to sponsor conferences or even buy a booth. If you’re a plaintiff class action attorney you KNOW who Top Class Actions is. On the home front, it’s getting HOT! It seems like it will be a very short spring and we’ll be hitting 100 degrees soon. We’re trying to hold off on taking the net off the pool as long as possible, but, when we start hitting 100 regularly we’ll have no choice BUT to open up the pool. If we don’t swim in the summer we have to keep the kids indoors, and that’s no fun. Sydney and Aubrey have to burn off lots of energy, and though we enjoy playing Uno every day that doesn’t help them burn off those young, crazy, fountains of energy. I am looking forward to it, though. We have so much fun playing in the pool and its good exercise for me as well. One more way for Daddy to burn the flab and have some fun!

 

OK, I have to run, it’s month’s end and we’re not done yet, so I need to get my butt back in front of my clients. More lawsuit and settlement updates are below!
