University of Miami

A settlement has been reached in a class action lawsuit related to a data breach at the University ocf Miami. If you received a letter from the University of Miami Miller School of Medicine stating that documents stored with a vendor containing your Protected Health Information could not be located in 2013, you could be entitled to a cash payment and other benefits from a class action settlement.

According to the data breach class action lawsuit, the University of Miami provided an off-site storage vendor with certain Protected Health Information (PHI) of the University of Miami School of Medicine, and that the documents containing the patient information cannot be located. The plaintiff alleges the University of Miami failed to adequately safeguard the health records. Patients’ medical information and private identifying information, including Social Security Numbers, names, dates of birth and billing information were allegedly compromised during the data breach.

The University of Miami denies any wrongdoing or legal liability but has agreed to settle the class action lawsuit to avoid the cost of trial.

Who’s Eligible

Class Members of the data breach class action settlement include patients of the University of Miami Miller School of Medicine whose PHI was contained within documents stored with a document storage vendor that could not be located in 2013.

Potential Award

Up to $500 to Class Members who have incurred a monetary loss by the University of Miami’s inability to locate documents containing their PHI.

Proof of Purchase

You must submit documentation generated by a third party establishing:

  • A monetary loss incurred by you; and
  • The specific amount of the monetary loss.

Examples of documents prepared or generated by a third party include documents you received from a banking institution, credit card issuer or tax preparer.
