  Wells Fargo TCPA Class Action Settlement
Wells Fargo NA has agreed to pay nearly $14 million to settle a class action lawsuit alleging it violated the Telephone Consumer Protection Act (TCPA) by using automated dialing or prerecorded voice technology in effort to collect on a consumer credit card account. If you received a call on your cell phone from Wells Fargo that was made with an autodialer or featured an automated voice message, you could be eligible for a cash payment from the class action settlement. New Study Suggests Lipitor Increases Diabetes Risk By 50%A new study published in the medical journal Diabetologia suggests the use of popular cholesterol drugs like Lipitor may be associated with a nearly 50 percent increased risk of type-2 diabetes. This study is the latest in a growing body of research suggesting a strong connection between statin medications and an increased risk of type-2 diabetes side effects.

 

Xerox Call Center Employees May Opt In to Class Action Lawsuit  – A notice has been issued for certain call center employees of Xerox Business Services LLC, Livebridge Inc., Affiliated Computer Services Inc. and Affiliated Computer Services LLC to opt in to a class action lawsuit. The class action lawsuit alleges that some current and former call center employees are owed unpaid wages including overtime pay.

 

Blood Thinner Eliquis May Cause Fatal Internal BleedingEliquis (apixaban) is a blood-thinning medication in the same family of anticoagulants as Pradaxa and Xarelto. Anticoagulants are designed to reduce the likelihood of dangerous blood clots. However, there is currently no reversal agent for Eliqus internal bleeding, meaning this complication could be fatal. If you or a loved one took Eliquis and suffered injuries such as uncontrollable internal bleeding, gastrointestinal bleeding, hemorrhaging, kidney bleeding or death, you may have a legal claim.

 

National SunTrust Mortgage Settlement SunTrust Mortgage Inc. has agreed to pay $500 million as part of a class action settlement with the federal government and dozens of attorneys general related to SunTrust’s alleged misconduct regarding its mortgage servicing and foreclosure practices. If you were a SunTrust borrower who was foreclosed upon, you may be eligible for benefits from the SunTrust settlement.

Ethicon Agrees to Settle Vaginal Mesh Bellwether Trial Ethicon has reportedly reached a settlement in a vaginal mesh bellwether trial in West Virginia federal court. The plaintiff’s claims were resolved after five days of trial against the Johnson & Johnson subsidiary. Manufacturers of vaginal mesh are currently facing thousands of lawsuits filed by women who allege the implants are defective and caused them to suffer painful, debilitating, and sometimes permanent injuries.

 

2013 Government Shutdown Lawsuit: How to Join if You’re an Essential EmployeeThe U.S. Justice Department will be notifying hundreds of thousands of “essential employees” who were required to work during the 2013 government shutdown about their right to join a class action lawsuit and seek additional pay for their work during that time period. If you do not receive a notice, but believe that you should, you may still be able to join the government shutdown class action lawsuit. Testosterone Lawsuit: Depo-Testosterone Caused Heart Attack A man alleges he suffered from several adverse health events, including a heart attack, while taking Depo-Testosterone. The plaintiff alleges Pfizer failed to adequately warn about the dangers associated with its testosterone product, and aggressively marketed the product to men who were simply experiencing the natural signs of aging.

Update from the President of TCA

 

Good morning everyone! I hope you had a fantastic week! It was a busy one as always around the Hardy home. It’s warming up, the A/C is cranking every day, and the girls are running around as usual. That’s something I wasn’t truly prepared for. The VOLUME LEVEL when you have children. I can be sitting next to Aubrey on a bench and she still thinks it is appropriate to yell in my ear “DADDY! DID YOU SEE THAT BUTTERFLY?!?!?!” When the two girls are playing outside there is a constant barrage of laughter, screaming, screeching and I’m pretty sure I hear them NAYING like a horse on occasion. I think our neighbors believe we have both kids AND a menagerie. They’re such wonderful little people but I’m excited for the day they truly learn the difference between outside and inside voices, and the fact that when they are outside doesn’t mean they have to SCREAM EVERY SENTENCE JUST BECAUSE THEY’RE OUTSIDE. It’s pretty hilarious actually, but it can get a bit trying. Of course, once we open up the pool in a few weeks, my volume level will increase (and theirs) when I’m jumping into the pool yelling CANNONBALLLLLLLL!!!!

 

On the Top Class Actions side of things, we’re working through the plan for the rest of the year. We’re going to be pushing out a number of positive changes. Some that our clients have asked for and some that our viewers have asked for. It will keep us busy but the end result will be a larger, stronger, and better defined web destination for you. We only have so much time and money and I have to pick and choose which projects to work on. If it doesn’t help our viewers and our bottom line, I’m shelving them. My team has already worked extremely hard, and I’m lucky to have them, so I need to keep that in mind as we get wrapped up with shiny new projects to work on. Also, I DO enjoy spending time with my family so I can’t work 24/7. The girls wouldn’t allow it! OK, that’s all from me, here are some more lawsuit and settlement updates!
