FTC TracFone Class Action Settlement
Under the terms of a settlement with the Federal Trade Commission (FTC), TracFone will pay $40 million to consumers to resolve allegations it falsely promised consumers “unlimited” data. If you purchased a TracFone “unlimited” data plan and had your data speeds throttled, slowed or had your plan terminated, you could be eligible for benefits from the class action settlement.

 

Another Xarelto Bleeding Lawsuit Joins Growing Legal ActionA plaintiff has filed a Xarelto bleeding lawsuit after she suffered severe gastrointestinal bleeding, allegedly as a result of taking Xarelto. She alleges the drug’s makers were aware, or should have been aware, of the dangerous bleeding risks associated with Xarelto, but aggressively promoted it as superior to other anticoagulants.

 

Foogo Thermos False Advertising Class Action Settlement  – Thermos LLC has reached a class action settlement over allegations its “leak-proof” Foogo reusable drinking bottles are actually prone to leaking. If you purchased a Foogo bottle, you may be eligible for cash benefits or free products from the class action settlement.

 

Quinolone Antibiotics Linked to Liver ToxicityQuinolone antibiotics such as Cipro, Avelox and Levaquin may carry the risk of liver damage. Mild liver damage may not have many noticeable symptoms, while more severe cases of liver damage may cause a wide variety of painful symptoms. If you took Cipro, Avelox, Levaquin or another quinolone antibiotic and were diagnosed with liver failure, Stevens Johnson Syndrome or toxic epidermal necrolysis, you may have a legal claim.

 

Wendy’s Settles Wheelchair Access Class Action Lawsuit – A settlement has been reached in a class action lawsuit over allegations certain Wendy’s restaurant locations have architectural barriers that limit access to wheelchair-bound customers, in violation of the Americans with Disabilities Act. If you use a wheelchair and have visited a Wendy’s restaurant, or plan to do so in the future, you may be affected by the class action settlement.

 

Calif. Woman Files Mirena Lawsuit for Uterine PerforationBayer has been hit with yet another Mirena IUD lawsuit alleging the intrauterine device perforated a woman’s uterus and caused her severe pain. The plaintiff alleges that Bayer misrepresents the safety of the Mirena IUD and puts women at risk. If you suffered Mirena IUD complications and had to have the device surgically removed because it migrated, you may have a legal claim. Find out if you qualify now.

 

Agriculture Street Landfill Class Action Settlement – A settlement has been reached in a class action lawsuit over hazardous materials from the Agriculture Street Landfill in New Orleans that were allegedly never remediated. If you have lived or worked near the Agriculture Street Landfill site, you may be eligible for a payment from the class action settlement.

 

Texas Resident Files Actos Bladder Cancer Lawsuit, Joins MDL A Texas man has filed an Actos lawsuit, alleging the drug’s manufacturer failed to adequately warn consumers and the medical community about the risk of bladder cancer associated with the drug. If you or someone you know took Actos and were diagnosed with bladder cancer or bladder tumors, legal options are available.

 

Whole Foods Sued in Sales Tax Class Action LawsuitWhole Foods Inc. has been hit with a class action lawsuit alleging it overcharged sales tax for consumers who used coupons to make grocery store purchases. According to the class action lawsuit, Whole Foods improperly charges customers sales tax on the full purchase price even though it should only charge sales tax on the price the customer actually paid for the merchandise.

 

Onfi’s Link to Stevens Johnson SyndromeThe anti-seizure medication Onfi has been linked to a serious skin condition known as Stevens Johnson Syndrome. Although SJS is rare, it can be deadly, and medical experts believe that manufacturers of drugs linked to the reaction should be required to include a warning on the drugs’ labels. If you or a loved one developed SJS after taking a medication, you may be eligible to take legal action against the drug’s manufacturer.

Update from the President of TCA

Good morning everyone! I hope you had a great and productive week! I also hope you didn’t bet big on the Seahawks. What a game, ehh? I didn’t attend the Super Bowl even though it was in Phoenix simply because I don’t particularly care for either team. In addition, I’m not going to spend thousands of dollars on tickets on two teams I don’t care about just to cross the Super Bowl off my bucket list. Nope! No way! Hopefully the Arizona Cardinals will be HEALTHY next year. If they make it to the big game next year, I think we’ll be forced to make a trip out to Santa Clara. That’s a LONG way away though and I’m scared how much tickets will cost when I’d be competing with Twitter, Google and the other tech millionaires for seats to the big game. We’ll see! Either way, I’m already looking forward to August and the preseason. Maybe I’ll start dragging my beautiful bride to Suns basketball games or Arizona United soccer games. I need some kind of sports fix for the next few months!

 

On the Top Class Actions side of things I’ve been busy juggling clients and projects. Due to our exclusive business model for law firms, there are only two ways to increase revenue. First, add more campaigns. Second, increase how much we CHARGE for those campaigns. As we grow, I am splitting up bundled campaigns into distinct and separate entities as long as we can support it. This can create some friction with my existing clients as they’re asked to either pay 2x as much for something they used to get for “free” or they’re upset because another law firm will be filing similar cases, which they feel is encroaching on their legal “turf.” It’s a very tough juggling act as I try to take care of my clients while making sure that we have enough money to pay our bills and our people. I just sent out W-2s to my team and I can proudly say we spent MUCH, MUCH more on our team in 2014 than in any other year. Growth means more money coming in, but it also means more money going out. I’m very happy I’m in a position where I can afford to pay my people (and they even got raises last year). That’s something I think is special about our company. Even though my team is spread all over the country, I work hard to make sure everyone feels included, and when the company does well, THEY do well. We’re building something really special here and I’m happy that our awesome viewers (YOU) and team are here to help me do it.
