If you purchased joint health supplements containing glucosamine within the past 10 years, chances are you may be eligible to claim between $3 and $50 from a class action lawsuit settlement with Schiff Nutrition International Inc., Schiff Nutrition Group Inc. and Reckitt Benckiser LLC about the labeling and packaging of the products, which may have misled consumers.

The glucosamine supplement settlement resolves a 2011 class action lawsuit filed by plaintiff Luis Lerma (Lerma v. Schiff Nutrition, et al.) that alleges the labeling and packaging of the above listed joint health products contain false, deceptive and misleading statements and do not warn consumers about the potentially harmful side effects of the supplements. Two other plaintiffs, Nick Pearson and Muriel Jayson, were later added to the complaint.

Specifically, the plaintiffs allege that the defendants marketed the line of supplements as an effective treatment for the key symptoms of arthritis without scientific proof that the products are effective arthritis remedies.

Schiff vigorously denies the allegations and stands by these joint health products, their labels and packaging, and their safety and efficacy. The company agreed to a $5 million class action settlement in March 2014 to resolve the litigation and avoid the uncertainty and expense of going to trial.

The total value of the class action settlement is now $6.5 million, according to the Settlement Notice.

A California federal judge preliminarily approved the deal in November 2014. The judge will consider final approval of the Schiff glucosamine supplement settlement at an Oct. 30, 2015 Final Fairness Hearing.

Who’s Eligible

Class Members of the Schiff supplement settlement include all U.S. residents who purchased for personal use, and not for resale or distribution, any of these “Covered Products” between Jan. 1, 2005 and May 27, 2015.

The brand names of these covered products include:

  • Move Free Advanced
  • Pain Free
  • Lubriflex
  • Great American Nutrition
  • Metaform
  • Muscle Tribe
  • Victory
  • Schiff
  • Kirkland
  • Member’s Mark
  • Spring Valley
Potential Award

$3 to $50. Payments will vary based on the number of Covered Products purchased between Jan. 1, 2005 and May 27, 2015 and whether proof of those purchases is provided.

In addition, Schiff has agreed to make certain modifications to the marketing and labeling for the Covered Products.

If the total number of valid claims exceeds the $6.5 million settlement value, then the amount of money each Class Member will receive will be reduced pro rata.

Proof of Purchase

Proof of purchase is not necessary but will increase the amount of money you could receive.

Class Members who submit proof of purchase, such as a receipt, product packaging containing a readable UPC code and lot number, or documentation showing the date and location of a product purchase may claim $10 per bottle for up to 5 bottles (a total of up to $50).

Class Members without proof of purchase may claim $3 per bottle for up to 4 bottles (a total of up to $12).

    ..I am unable to cash my check ! The little denial slip that comes from the register says: “All accounts blocked call collections.” What in the world does that mean ?! I’m going to call the 877# on the check & will follow up with you guys later .

      THE FOLLOW UP :

      I attempted to cash the check again at another Kroger (Mississippi) . The same message was produced “All accts. blocked , call collections.” This time I was given a number to call . 800-917-6484 Cetergy. The young lady told me that Kroger was ALREADY holding a bad check from this company ?! They would accept no more. I was shocked beyond words really! I will just deposit the check in my bank tomorrow .

      The law firm, KCC, is very lazy and doesn’t like consumers. You can call their main line at 866.381.9100. They will then transfer you to someone who will take your information, and then you’ll supposedly get a call back within a few days. I did this one time before and they never called me back, but I got a check. So it’s worth a shot.
