The Schiff glucosamine settlement resolves allegations that the supplement manufacturer misled consumers with deceptive marketing claims regarding its joint health products.
Plaintiffs say Schiff advertised its products as an effective method of treating arthritis but failed to warn of potentially harmful side effects in violation of consumer protection laws.
Defendants Schiff Nutrition International Inc., Schiff Nutrition Group Inc. and Reckitt Benckiser LLC denied the allegations but agreed by pay $6.5 million to avoid the expense of ongoing litigation.
In addition to the settlement fund, Schiff also agreed to remove certain statements from its joint health supplements including: “repair joints,” “rebuild joints,” “rejuvenate joints,” “repair cartilage,” “rebuild cartilage” or “rejuvenate cartilage.”
The company has the option to include those terms two years following this settlement, but only if “an independent, well-conducted, published clinical trial that substantiates the representations.”
Class Members included all U.S. consumers who purchased (for household use) any of the following Schiff brand supplements between Jan. 1, 2005 and May 27, 2015:
