skelaxin class action

A $2.5 million settlement has been reached in a class action lawsuit alleging King Pharmaceuticals Inc. conspired to prevent and delay generic competition to its muscle relaxant Skelaxin, resulting in artificially inflated prices. If you operate a business in Tennessee and indirectly purchased Skelaxin for resale since Nov. 4, 2005, you may be eligible for benefits from the class action settlement.

The Skelaxin class action lawsuit alleged King deprived the plaintiff and Class Members of full and free competition in the market. The class action lawsuit sought compensatory damages and restitution.

King denies the allegations but agreed to settle the class action lawsuit to avoid the expense and uncertainty of ongoing litigation.

Who’s Eligible

Class Members of the Skelaxin class action settlement include anyone that operates a business in Tennessee and indirectly purchased Skelaxin for resale since Nov. 4, 2005. To qualify as a Class Member, the purchases must not have been directly from King and they must not have been for your own personal use.

If you operate a business outside of Tennessee, your rights may be affected by a separate Skelaxin class action settlement. Learn more here.

Potential Award

Varies. Payments will be distributed to Class Members in proportion to their relevant purchases of Skelaxin in Tennessee, up to the amount of damages suffered.

Proof of Purchase

Class Members may be asked to provide records of their purchases of Skelaxin. However, you do not need to submit proof of purchase at the time you submit your Claim Form.
