Class Action Lawsuit Settlement Case(s):In re: Southwest Airlines Voucher Litigation, Case No. 11-cv-8176, U.S. District Court, Northern District of Illinois, Eastern Division.
Company(ies): SOUTHWEST AIRLINES CO.
Address to submit a claim form (REQUIRED):
Phone Number to call for assistance: (888) 288-2153
Details: Southwest Airlines has reached a class action lawsuit settlement with customers who received Southwest drink coupons but were unable to redeem them. If you received a Southwest drink coupon through the purchase of a Business Select ticket prior to August 1, 2010, but did not redeem it for a free drink, you can claim a free replacement voucher through the class action settlement.
At least 5.8 million Southwest drink vouchers were never redeemed, according to the settlement motion, which means hundreds of thousands — if not millions — of customers may be eligible to file a claim.
The Southwest drink voucher settlement will resolve a class action lawsuit, titled In re: Southwest Airlines Voucher Litigation, that alleges the company breached its contract with customers when it announced in August 2010 that it would no longer accept certain drink vouchers – even though they did not contain an expiration date.
Southwest denies it violated any laws in revoking the drink vouchers, but agreed to pay between $29 million and $58 million to resolve the litigation.
Under the proposed class action lawsuit settlement, each Class Member will receive one drink voucher to replace any voucher that was not redeemed prior to August 1, 2010. There is no limit or cap on the number of replacement vouchers per Class Member, which explains the gap in the settlement fund. Also, you do not need to still have the actual unredeemed drink coupons in your possession in order to submit a Claim. However, your claim is subject to an audit by Southwest pursuant to its records.
Note: this class action lawsuit settlement only involves drink vouchers issued through a Business Select ticket, not through the Southwest “Rapid Rewards” frequent flyer program. You will not receive Replacement Drink Vouchers for Rapid Rewards drink coupons that you received, but did not redeem.
The only way to receive a Replacement Drink Voucher is to submit a claim either online at www.SouthwestVoucherSettlement.com or mailed to the Settlement Administrator by September 2, 2013.
Claim Forms and more information on your rights in the Southwest Drink Voucher Class Action Lawsuit Settlement can be found at www.SouthwestVoucherSettlement.com.
