Gogo LLC and Gogo Inc. have entered into a settlement to resolve claims in a potential class action lawsuit that was initially filed in February 2014.
The plaintiffs in the class action lawsuit alleged that Gogo enrolled customers in a plan to access inflight Internet services and continued to charge their credit cards on a recurring basis. The automatic renewal class action lawsuit claims that Gogo engaged in this improper act without receiving proper authorization from or providing proper disclosure to customers.
The plaintiffs said they believed they would only be charged for a single month of service, but Gogo continued to charge their credit card accounts monthly for their service.
Gogo has denied the claims and maintains that they did not act in an unlawful or wrongful manner. The Gogo class action settlement was reached not as a result of a court decision, but as a joint effort from both sides of the case coming to an agreement to resolve the claims.
For Class Members who wish to exclude themselves from the Gogo settlement, comment, or object, those actions must be completed by March 4, 2016.
UPDATE: The Gogo settlement was granted final approval on April 5, 2016.Â
Who’s Eligible
There is an Initial Class and a Supplemental Class included in the settlement.
The Initial Class is defined as follows:
- All Gogo Customers who, between April 1, 2010 and Dec. 31, 2012, subscribed to a Gogo Monthly Pass and only used the Gogo Service during the first month of their subscription.
The Supplemental Class is defined as follows:
- All Gogo Customers who, between Jan. 1, 2013 and March 31, 2015, subscribed to a Gogo Monthly Pass but only used the Gogo Service during the first month of their subscription.
Potential Award
Up to 6 Gogo inflight internet service One-Day passes plus a One-Hour pass.
The number of passes that will be distributed to eligible Class Members depends on the date of purchase of the Gogo service and how many months the consumer’s credit card was charged for the service.
There are two Classes in the settlement: an Initial Class and A Supplemental Class. Some Class Members will be eligible to receive benefits from both Classes.
Initial Class benefits are as follows:
- If you paid for 1 to 4 months of unused Gogo Service, you will receive 1 One-Day Pass.
- If you paid for 5 to 8 months of unused Gogo Service, you will receive 4 One-Day Passes
- If you paid for 9 or more months of unused Gogo Service, you will receive 6 One-Day Passes.
Supplemental Class benefits are as follows:
- If you paid for any number of months of unused Gogo Service, you will receive 1 One-Hour Pass.

Class Members must submit a valid Claim Form and provide their signature certifying under the penalty of perjury that they purchased a Gogo monthly pass, they were unaware that the Gogo charge was a monthly recurring charge, paid for the recurring charges and did not receive a refund or reimbursement for the charges incurred.

What is going on….any updates?
UPDATE: The Gogo settlement was granted final approval on April 5, 2016.Â
I had a similar issue to the one above. When I went to sign up for the Weight Watchers mobile, I received in invite for Vivalux eye cream and wrinkle serum. It was proported to be just for the cost of shipping and handling. I received the eye cream and wrinkle serum, but also received face cream that I did not order. I thought well, I will just try it for the cost of shipping. I then learned that in December, they had me on reorder of this crap at $98.00 each that they automatically withdrew from my credit card! I called and requested a cancellation! They told me I had to send it back to a different address and it will take up to 30 days once they receive the return! What crap! Here is my cancellation confirmation via email! Again, I didn’t order the face cream, they just sent it to me! I didn’t see in any of the literature that there was an automatic renewal at $98.00 each!!!! The other order number is 1897707.
