A proposed settlement has been reached in a class action lawsuit regarding substitutions in floral arrangements purchased on FTD.com. If you purchased a floral arrangement in California from FTD.com between April 1, 2011 and March 31, 2015 involving a substitution, you could be eligible for payment from the class action settlement.

Plaintiff Rachelle Erratchu filed the class action lawsuit in July 2015, claiming that flowers of lesser quality were substituted for two arrangements that she purchased. According to the FTD.com class action lawsuit, FTD did not properly disclose its substitution policy, which allows florists to make substitutions as may be necessary to ensure timely delivery of the floral arrangements. Erratchu claims that she would not have purchased the floral arrangements from FTD if she had known about the company’s substitution policy.

FTD denies any wrongdoing and maintains that it fully disclosed its substitution policy. However, FTD has agreed to settle the flower substitution class action lawsuit to avoid further expense, inconvenience and distraction of litigation. In addition to providing monetary benefits to Class Members, FTD has also agreed to make modifications to its disclosure of the flower substitution policy.

If you wish to exclude yourself from or object to the FTD class action settlement, you must do so no later than Nov. 3, 2015.

Who’s Eligible

You are a Class Member of the FTD flower substitution settlement if FTD’s records indicate you:

  • Ordered and paid for a floral arrangement from FTD.com between April 1, 2011 and March 31, 2015;
  • Provided a California billing address;
  • Did not receive any refund, whether partial or whole, on your purchase; and
  • FTD’s records indicate a substitution may have occurred for your purchase.
Potential Award

Class Members who submit a valid Claim Form will receive either a check for $8.50 or a $20 coupon to be used toward purchases at www.ftd.com.

Proof of Purchase

Claimants must provide the approximate date on which they purchased a floral arrangement from FTD.com, along with a copy of a government-issued identification card to prove their identity.
