Lipitor diabetes lawsuitAnother Lipitor lawsuit has been added to the national Lipitor type-2 diabetes multidistrict litigation (or Lipitor MDL) by a Georgia couple. They claim the wife experienced unwanted Lipitor side effects after taking the Pfizer Inc. high cholesterol treatment.

Plaintiffs Mary S. and Collin S. of Georgia filed this Lipitor diabetes lawsuit against Pfizer in May of this year, alleging that 68-year-old Mary developed type-2 diabetes as a result of her use of Lipitor.

Mary was originally prescribed Lipitor in July 1999 and she continued to take the cholesterol-managing medication until sometime in June 2008. However, in February 2007, Mary was diagnosed with type-2 diabetes, which she alleges is a direct result of her use of Pfizer’s drug, Lipitor.

According to the Lipitor type-2 diabetes lawsuit, “As a direct, proximate and foreseeable result of Defendants actions or inactions, Plaintiff suffered grievous bodily injury and consequently economic and other losses, including but not limited to pain and suffering, emotional distress and loss of enjoyment of life.”

Mary and her husband Collin bring several allegations against Pfizer, including claims of negligence, negligent misrepresentation, negligent design, design defect, failure to warn, breach of express warranty, breach of implied warranties, fraud and misrepresentation, constructive fraud, loss of consortium, unjust enrichment, and punitive damages.

This Lipitor Type-2 Diabetes Lawsuit is Case No. 2:15-cv-01942-RM, in the U.S. District Court for the District of South Carolina, Charleston Division.

It is part of the Lipitor MDL, In re: Lipitor (atorvastatin calcium) Marketing, Sales Practices and Products Liability Litigation, MDL No. 2502, in the U.S. District Court for the District of South Carolina, Charleston Division.

Type-2 Diabetes and Lipitor Users

According to reports, over 4,000 women have reported they developed Lipitor type-2 diabetes after taking Pfizer’s cholesterol treatment. As a result of this unfortunate Lipitor side effect, many of these women have filed Lipitor lawsuits. The majority of these type-2 diabetes lawsuits have been consolidated in the Lipitor MDL in South Carolina federal court.

The FDA issued a public health notice in August 2011 that required Pfizer to include new type-2 diabetes risk information in their Lipitor marketing and labeling, which includes warnings for other Lipitor side effects. A year later, the agency followed this health notice with a general mandate to all statin drug manufacturers besides Pfizer to include a type-2 diabetes warning.

Pfizer finally complied with the FDA mandate in February 2012 and updated Lipitor’s drug and product labels to feature a type-2 diabetes risk warning. While this labeling action by the pharmaceutical company benefits current and future Lipitor consumers, it does not reverse the Lipitor side effects many female consumers have suffered prior to 2012. As a result, many of these individuals have filed Lipitor lawsuits, seeking justice for their personal injuries related to their development of type-2 diabetes.
