McDonald'sMany McDonald’s employees who  were hired for McDonald’s management positions, such as Directors of Operations, District Manager Supervisors, and District Trainers, will rely on their 401k plans to provide or supplement their income during retirement. Unfortunately, many of these employees may see the value of these McDonalds 401k retirement plans drop as a result of the fast food chain’s poor fiduciary choices.

According to a McDonalds 401k plan class action lawsuit investigation, lawyers are investigating whether McDonald’s did not invest the money of these 401k plans wisely, which may have caused the retirement plans to drop for plan participants such as McDonalds managers, supervisors, District Manager Supervisors, and District Trainers.

However not all is lost, as these McDonalds employees in these managerial positions may be eligible to pursue legal action against the fast food restaurant chain for allegedly violating their fiduciary duties through a class action lawsuit.

McDonalds 401k Plan Allegations

On McDonald’s career website, the company states employees (including, those in managerial positions) are allowed to put one to 50 percent of their paychecks into a 401k plan for their retirement.

Additionally, the website goes on to claim that McDonald’s will match an employee’s 401k plan contribution by 300 percent for the first one percent of an employee’s wages that  are deferred to the McDonalds 401k plan.

Furthermore, for each dollar spent on the next 4 percent of a McDonald’s employee’s contribution to his or her 401k plan will be matched 100 percent by the fast food chain.

However, class action lawyers are investigating whether McDonald’s District Trainers, District Manager Supervisors, and other employees in management positions have been affected by unwise and unsuitable investments for these 401k portfolios.

If unwise investments were made, they could drive down the value of these McDonald’s employees’ retirement funds, which could be constituted as a breach of fiduciary duty, since the McDonalds 401k plans may not be earning as much as expected or promoted by the company.

Possible McDonalds 401k Plan Litigation

These McDonald’s managers may be able to join a McDonalds 401k class action lawsuit investigation against the fast food restaurant chain under the Employee Retirement Income Security Act. ERISA was established in 1974 in order to protect individual employees’ retirement plans and also established the minimum health plan and pension standards for businesses and companies like McDonald’s.

Under ERISA statutes, fiduciaries like McDonald’s are required to follow certain guidelines when managing employees’ benefit plans like the McDonalds 401k plan. If McDonald’s and other fiduciaries do not act in the best interests of employees, they can be considered liable under ERISA.
