Costco class action lawsuitAn unpaid overtime class action lawsuit has been filed against Costco Wholesale Corp.

Douglas T., the lead plaintiff in the unpaid overtime class action lawsuit, filed the complaint against Costco in October on behalf “of himself and all other similarly situated, and on behalf of the general public.”
The unpaid overtime class action lawsuit seeks to include many individuals who have been allegedly wronged by Costco and have had wages wrongly withheld. Subclasses in the Costco class action lawsuit were listed as follows:

  • All hourly workers not paid wages
  • All hourly workers subject to an automatic deduction of 30 minutes for meal breaks
  • All hourly workers denied rest breaks and rest premium pay
  • All hourly workers denied meal breaks and meal premium pay
  • All hourly workers willfully denied timely pay
  • All drivers not paid for all hours worked
  • All drivers not paid at the “legal piece overtime rate”
  • All drivers not provided paid rest breaks

Costco has denied the allegations.

Douglas has made several claims against Costco relating to the way the company allegedly treated overtime and lunch breaks. The unpaid overtime class action lawsuit states that Costco had a “continuous and widespread policy of ‘clocking-out’” individuals for a 30-minute or hour-long break and deducted from the paid time, even if they worked through their meal periods, which the plaintiff alleged was common.

Costco is one of many defendants named in unpaid overtime class action lawsuits. Companies such as Rite Aid, H&R Block Enterprises Inc., and Prudential Insurance Co. of America have already paid millions to victims who have alleged unpaid overtime abuse in class action lawsuits. Thousands of individuals are unaware of overtime laws and may be entitled to join an unpaid overtime class action lawsuit.

Douglas is seeking millions of dollars for Class Members. For unpaid meal time alone, he alleges more than $17.16 million is owed to Class Members. Due to the amount of money involved and the size of the putative Class, the case is being moved to a U.S. District Court.

This Costco Unpaid Overtime Class Action Lawsuit is Case No. 14CV2778, in the U.S. District Court for the Southern District of California.
