Zales False Reference Pricing Class Action Lawsuit Overview: 

  • Who: Jane Villalpando filed a class action lawsuit against Zale Corporation. 
  • Why: Villalpando claims Zales uses false reference pricing to make its sale items appear at a greater discount than is actually the case. 
  • Where: The class action lawsuit was filed in California federal court.

Zale Corporation uses false reference pricing to make sale items on its website appear to be at a greater discount than what is true, a new class action lawsuit alleges. 

Plaintiff Jane Villalpando claims Zale advertises fictitious “original prices” for sale items that were never actually sold at the alleged false reference price. 

In addition to not being honest about the discount amount, Villalpando argues the alleged tactic “artificially inflates the true market price for these products” by raising a consumer’s internal reference price. 

“Consequently, this reference pricing schemes enable retailers, like Defendant, to sell products above their true market price and value—and consumers are left to pay the price,” the Zales class action states. 

Villalpando says she purchased several pieces of fsale jewelry on Zales website that were listed under what she argues was false reference pricing. 

Zales Class Action Claims Discount Price Compelled Consumer To Make Purchase

The alleged false reference pricing gave Villalpando more urgency to purchase the product since she felt the discount “would likely not last,” according to the Zales class action. 

Villalpando argues that only later would she find out that the items were never listed on the website for what was being as used as their “original price.” 

“This product was never offered for sale at the original price listed on Zales’ e-commerce website and certainly not within the 90 days preceding Plaintiff’s purchase,” the Zale’s class action states. 

Villalpando claims Zales is in violation of California’s False Advertising Law, Unfair Competition Law and Consumer Legal Remedies Act

Villalpando wants to represent a California class of consumers who purchased a product from zales.com or zalesoutlet.com that was for sale under what turned out to be a false reference price. 

Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with statutory, actual, and punitive damages for herself and all class members. 

Zales previously failed to have dismissed a class action lawsuit from 2019 that alleged the company does not honor the terms of the lifetime warranties it sets.

    After ordered a ring and having it cancelled a few days before expected delivery because they didn’t have the ring. We wound a new one. We received it at a discounted price due to the holidays or so we think. Love my ring and we have the lifetime warranty on it.

    Yes mam. So I had received my wedding ring for Christmas last year. My husband found a steal from one of yalls outlet stores around the time of black Friday. I have a 2 Carat military diamond double frame vintage style ring in 10k white gold. I had taken it to be replaced as my husband accidently stepped on my ring as it was knocked off the counter at some point during cleaning. It caused one side of the ring to miss shape and of course 2 stones were missing. Two weeks later, yesterday I get a call saying they couldn’t fox my ring. That they were not going to be able to fix my ring even with the lifetime warranty but offered to exchange my ring. OK cool. So went to look to see trying to make things simple.

    I was told that they were only going to be able to allow me a ring for the
    sales price we paid vs the value of the ring…. go to the website to look and literally can’t get even a half a carat of what they are offering. So they pretty much said i would pay the difference on anything over my limit which is everything… Not only that but keep my ring that’s valued more then the sale price of 1499. So they can do as they please and make triple off my ring that didn’t even come from that zales store. Now we have paid for lifetime warranty that is useless unless for cleanings basically by this claim, my ring is still broke, they are trying to basically rip me off, and going to act like I’m just suppose to be OK with it. The worst part is I asked if I could have the stones removed and reset into a new setting that could be made and they said yes and offered to do it but it would charge me. Sooooooo I have insurance that isn’t covering to fix my ring, but they can set the stones into the same set if I choose but I’ll have to pay for it!!!! Like WHAT!?! Pretty sure my issue falls under both of Zales lawsuits. I have filed a complaint with zales, i have reported to the BBB and will be speaking to the DM this morning to try and have this issue resolved rightfully one last time.

    They cancelled 3 of my orders due to false claims of payment issues then on my last order took the money out of my account and sent no order information. Received the ring with a cracked diamond and they refused to replace/exchange it without paying extra.

    Have had numerous diamonds fall out of my engagement ring, bought at an outlet store using their bridal sale discount. They refuse to replace the ring, even though the one I have clearly has a major design flaw. I’ve heard many others with the same complaints of stones falling out and Zales refusing to stand by their products. That greedy, heartless company needs to be stopped!!

    add me they send emails advertising a 10% off with the picture of the ring then tell you the ring doesnt qualify for the discount

      I bought a matching bracelet and necklace online it arrived 3 days later the brake necklace came from Omaha and it was fine new the bracelet came from Akron Ohio it was pre-owned faded discolored just horrible that they even put it in a box and mail it to me when I called I was told that the bracelet and necklace weren’t offered in stores it was an online exclusive I informed the female and text message to keep a record of this deceitful practice and black of humanity and failure to disclose that we are buying second hand or pre-owned jewelry I was told that again by someone else that it is made when you order it and I had to tell her no they try to force me to take digital gift card in order for my next purchase I want nothing else to do with Zales I want my money back and they kept telling me to just mail it back in the refund me all of my money and then I bought the lifetime warranty which says it doesn’t even cover pre-owned jewelry I’ve built my own case I just want to sue
