Progressive has agreed to settle a class action lawsuit that accused the insurance company of deceptive business practices by having its website recommend Massachusetts consumers with health insurance purchase automobile insurance with a $8,000 Personal Injury Protection (PIP) deductible.
Lead plaintiff Wanda Estrada claims that when she answered “yes” to the “health insurance question” on the Massachusetts direct sales website, it automatically recommended that she purchase car insurance that contained an $8,000 PIP deductible instead of a $0 PIP deductible.
The Progressive insurance class action lawsuit states that when Estrada was involved in a automobile accident and tried to receive PIP benefits through the car insurance policy, she was denied based on the $8,000 deductible.
PIP is a type of car insurance that covers medical bills, lost wages, and funeral and other expenses resulting from a collision.
Progressive denies any wrongdoing or liability but agreed to the terms of the class action settlement to avoid further litigation expense.
Who’s Eligible
The Progressive PIP Insurance class action lawsuit settlement is open to all Class Members who purchased the Massachusetts automobile insurance policy through the Progressive website between May 1, 2008 and April 27, 2010.
Class Members must have answered “yes” to the health insurance question during purchase stating that he or she was covered by health insurance and the car insurance policy contained an $8,000 PIP deductible.

OMG – The using Rust Consulting faurbault Minnesota. Rust is horrible go to riff off report. Com over 50 complaints and BBB. They will keep posting a distribution date of funds for at least five years to keep courts off there back after ccourts told them to release funds. They lie say technical difficulties and they continue on process thank you for your patience. Lawyers are working putting Rust out of business. The morgage class action and Korean airlines class action. Rust Consulting is a bunch of thieves
