The Navy Pier IMAX has agreed to pay as much as $455,000 in order to settle a class action lawsuit stemming over allegations that the theater violated the Fair and Accurate Credit Transactions Act (FACTA).

Lead plaintiff Scott Redman claims that the IMAX Chicago Theater printed more than the last five digits of customers’ credit or debit card numbers on receipts in violation of FACTA laws.

The IMAX FACTA class action lawsuit does not allege that Redman suffered from any actual monetary damage so in order to succeed in court he would need to prove that IMAX willfully violated FACTA requirements.

According to the IMAX class action lawsuit settlement, Class Members who submit a valid Claim Form before the deadline of Feb. 8, 2016 will be entitled to receive a portion of the Settlement Fund.

IMAX denies all allegations, liability and wrongdoing but has agreed to the terms of the FACTA class action settlement in order to avoid further litigation costs.

The FACTA class action settlement does not involve any IMAX theaters other than the Navy Pier Theater in Chicago.

UPDATE 2: On Mar. 25, 2016, settlement checks were sent out but those checks had an incomplete routing number. According to the settlement administrator, new checks will be sent out on Mar. 31, 2016. Class Members who already deposited their checks and incur fees because of it will be reimbursed.

Who’s Eligible

The IMAX FACTA class action settlement is open to all Class Members who purchased either movie tickets or gift cards at the Navy Pier IMAX Theater box office in Chicago, Ill. between Nov. 4, 2011 through Nov. 7, 2013, using a credit or debit card and received a paper receipt for the transaction. 

Potential Award

$66

The IMAX Navy Pier will set up a FACTA Settlement Fund of at least $400,000 but it could increase to as much as $455,000.

IMAX class action lawsuit settlement Class Members who submit valid claims will receive a portion of the Settlement Fund after certain fees are paid. The amount Class Members get will depend on the number of valid claims received.

If Class Members receive more than $600, they will be required to submit IRS Form W-9 to receive payment.

To receive financial compensation, Class Members must submit a valid Claim Form no later than Feb. 8, 2016.

IMAX class action lawsuit settlement Class Members have the option of including the last four digits of the credit or debit card used to make a purchase at the Navy Pier Theater in order to verify their claim.

Class Members do not have to provide this information; however, they may be asked for additional information in the future to verify the claim.

    FYI Settlement website says checks sent but with incomplete routing number and will be resent 3/31-I would not deposit the first one to avoid fees.

    We have received your claim in the Redman v. IMAX Chicago Theatre (Navy Pier IMAX) class action settlement. However, we need additional information to verify your claim. Please submit information showing that, between November 4, 2011 and November 7, 2013, you paid by credit or debit card for a movie ticket or gift card at the Navy Pier IMAX Theatre box office in Chicago, Illinois (“Theatre”) or for a movie ticket or gift card online for pickup at the Theatre box office and received a paper receipt at the Theatre.

    Acceptable verification includes a receipt or credit/debit card statement, but we will consider other documentation or information showing the circumstances of your purchase.

    We must receive your information no later than March 9, 2016. You may submit your information by email at info@IMAXChicagoCardSettlement.com; by fax at 1-952-955-4589; or by mail at Redman v IMAX Chicago Settlement, c/o Dahl Administration, PO Box 3614, Minneapolis, MN 55403-0614. If we do not timely receive information adequate to verify your claim, it will be rejected and you will receive no payment from the Settlement Fund.
