Diamond Wireless LLC has agreed to pay $1.25 million to settle a class action lawsuit over printed receipts that contained consumers’ credit and debit card expiration dates in violation of the Fair and Accurate Credit Transactions Act (FACTA). If you used a credit or debit card at Diamond Wireless between April 24, 2011 and July 30, 2013, you could benefit from a class action settlement.
Class Members of the Diamond Wireless FACTA settlement include all individuals who used a credit or debit card to make a purchase at a Diamond Wireless retail location between April 24, 2011 and July 30, 2013.
Diamond Wireless has agreed to create a Settlement Fund of $1.25 million, which will be divided equally among Class Members after fees and costs are deducted. Class Members who submit a valid Claim Form will likely receive between $25 and $50, but could potentially receive up to a maximum payment of $500. The actual amount paid out will depend on the number of Class Members who submit valid Claim Forms.
Proof of Purchase
Class Members must submit a Claim Form indicating, under the penalty of perjury, that they made at least one purchase or transaction at a Diamond Wireless Location between April 24, 2011 and July 30, 2013 using a credit or debit card.
Claim Form Deadline
Ronald Betten, et al. v. Diamond Wireless LLC, Case No. 2:13-cv-02285-CBM-FFM, in the U.S. District Court for the Central District of California, Western Division.
The Diamond Wireless FACTA settlement will resolve a class action lawsuit (Betten, et al. v. Diamond Wireless) that alleged Diamond Wireless willfully violated FACTA by printing the expiration date on customers’ credit or debit card receipts between April 24, 2011 and July 30, 2013.
Diamond Wireless denies any wrongdoing but agreed to settle the class action lawsuit to avoid the expense and uncertainty of trial.
