Hisense class action lawsuit overview:

  • Who: Plaintiff Robert Macioce filed a class action lawsuit against Hisense USA Corp.
  • Why: Macioce claims Hisense falsely advertised certain models of its televisions as containing quantum dot light-emitting diode technology.
  • Where: The class action lawsuit was filed in New York federal court.

A new class action lawsuit alleges consumer electronics company Hisense falsely advertised certain models of its televisions as containing quantum dot light-emitting diode technology (QLED). 

Plaintiff Robert Macioce claims Hisense falsely advertised televisions as containing QLED technology, despite the televisions either not having the technology or having such negligible amounts that it did not meaningfully contribute to the performance or display output.

“Through this conduct, Hisense engages in unfair, deceptive, and fraudulent conduct with the intent to deceive the consuming public,” the Hisense class action claims.

Macioce wants to represent a New York class of consumers who purchased a Hisense QD5, QD6, QD65, QD7, U7 or U7N series model television marketed as containing QLED or QD technology and which did not contain QLED or QD technology, or contained QLED or QD technology in such negligible amounts as to not provide the advertised benefits.

Hisense knew its TVs didn’t have advertised QLED technology, class action claims

Macioce claims Hisense has long been aware that its QLED televisions either do not have the advertised QLED technology or include negligible amounts of the technology as to not provide the advertised benefits.

“Notwithstanding its longstanding knowledge, Hisense continues to advertise that certain of its QLED televisions have QLED technology,” the Hisense class action says. 

Macioce claims Hisense is guilty of fraud and negligent misrepresentation and in violation of New York’s consumer fraud statutes. 

He demands a jury trial and requests declaratory and injunctive relief and an award of actual, general, special, incidental, statutory and punitive damages for himself and all class members.

A consumer filed a separate class action lawsuit against Hisense last year over claims the company sold smart TVs with a defective main board that caused significant performance issues.
