A $9.5 million class action settlement ends claims that Freedom Mortgage Corp. placed unwanted calls to consumers in violation of federal law.
Approximately 1.5 million current and former Freedom Mortgage clients may be able to benefit from the settlement.
Class Members must have been clients of the company between Sept. 1, 2013 and July 22, 2019 and have received at least one call or voicemail from the company for which they did not give permission.
According to the Freedom Mortgage class action lawsuit, consumers were plagued by telemarketing calls from the mortgage company, including calls placed using autodialers and prerecorded messages.
The plaintiffs claimed that Freedom Mortgage violated the Telephone Consumer Protection Act, or TCPA, by placing these calls without the permission of the consumers they were calling.
The TCPA was enacted as a federal law in 1991 to protect consumers from unwanted telemarketing calls and other forms of advertisement.
The law contains a number of provisions, limiting companies from using telephone, fax, and text messaging for advertising purposes without the express written consent of the consumers they are attempting to contact.
The TCPA also limits the use of prerecorded messages and the use of automatic dialing systems. The plaintiffs in the Freedom Mortgage TCPA lawsuit claimed that the company used both of these methods to contact clients who had withdrawn their consent for such calls.
The plaintiffs alleged that they began receiving telemarketing calls after obtaining a mortgage in 2012 through Freedom Mortgage.
They say that the calls came despite the fact that they did not consent to receive such communications from Freedom when they obtained the mortgage or at anytime after.
The Freedom Mortgage TCPA class action lawsuit claimed that the company called the plaintiffs’ home phones, as well as cell phone and even a former employer. The plaintiffs say the mortgage company used an automatic dialing system and possibly a prerecorded voice to contact them.
According to the plaintiffs, they asked for the calls to stop and were told that a note would be put in the system; however, the calls continued.
Freedom Mortgage allegedly made the calls to tout their mortgage-lending and refinancing services.
“In sending these solicitation phone calls to individuals whose mortgages Freedom Mortgage had originated or serviced, Defendant takes no steps to acquire the oral or written prior express written consent of the Plaintiffs, or Class Members who received them,” stated the Freedom Mortgage TCPA class action lawsuit.
“Defendant placed, or had placed on its behalf, telephone calls en masse to thousands of cellular telephone numbers throughout the United States.”
According to the Freedom Mortgage TCPA class action lawsuit, an automatic telephone dialing system, or autodialer, was used by the company. The system allegedly utilized software to store a list of telephone numbers and then automatically called those numbers with the press of a single button.
Other consumers have also complained of Freedom Mortgage telemarketing calls, according to the plaintiffs. Complaints allegedly details experiences of consumers where they asked the company to stop but continued to receive calls, consumers receiving multiple calls asking clients to refinance their mortgages, and the company using clients’ work numbers to make telemarketing calls.
Freedom Mortgage has admitted no wrongdoing, but agreed to pay $9.5 million as a part of a class action settlement agreement to end the litigation.
Under the terms of the Freedom Mortgage TCPA class action settlement, Class Members will receive a share of the net settlement amount, estimated to be approximately $5.7 million after administrative costs, attorneys’ fees, and plaintiff awards are paid out. Each claim is expected to be approximately $37.
To benefit from the class action settlement, Class Members must submit a claim stating that they received at least one unauthorized call or voicemail from the mortgage company between Sept. 1, 2013 and July 22, 2019.
Claims can be made using an online claim form or by submitting a paper claim form by mail. Claims must be made by June 23, 2020.
Class Members who wish to exclude themselves or object to the Freedom Mortgage TCPA class action settlement must do so by June 23, 2020, as well. The final approval hearing for the settlement agreement is scheduled for Sept. 10, 2020.
Who’s Eligible
Class Members include current and former Freedom Mortgage clients who, between Sept. 1, 2013 and July 22, 2019, received at least one call or voicemail from the company for which they did not obtain permission.

Class Members must provide a Claim ID number from their mailed or emailed notice and submit a claim stating that they received at least one unauthorized call or voicemail from the mortgage company between Sept. 1, 2013 and July 22, 2019.
