Snapple class action alleges company falsely advertises fruit beverages as “all-natural”

Snapple all-natural class action lawsuit overview: 

• Who: Selina Valencia filed a class action lawsuit against Snapple Beverage Corp. 
• Why: Valencia claims Snapple sells fruit beverages that are falsely advertised as “All-Natural” since they allegedly contain chemical preservatives and added coloring.
• Where: The class action lawsuit was filed in New York federal court.

Snapple Beverage Corp. sells Snapple fruit beverages marketed as containing “All-Natural” ingredients, despite them actually containing chemical preservatives, among other things, a new class action lawsuit alleges. 

Plaintiff Selina Valencia claims the Snapple beverages cannot be considered “All-Natural” since they contain citric acid and added coloring as ingredients. 

Valencia argues Snapple is further misleading consumers by allegedly failing to disclose that it uses citric acid as a preservative. 

“Nowhere on the Product, including on the ingredient list, are purchasers informed that citric acid is a chemical preservative,” the Snapple class action states. 

Valencia wants to represent a New York class and multi-state consumer fraud class of individuals who have purchased a Snapple fruit beverage. 

Snapple markets fruit beverages to consumers who prefer products with ‘natural’ ingredients

Consumers who see a product marketed as “All-Natural” expect it to not contain anything that is artificial or synthetic, with a “large majority” preferring foods with “natural instead of artificial ingredients,” according to the Snapple class action. 

Valencia claims, meanwhile, that research shows that consumers will spend more money on food products they believe only contain natural ingredients. 

“According to a recent Nielsen survey, a significant majority of consumers are willing to pay more for foods with natural ingredients as opposed to artificial ingredients,” the Snapple class action states. 

Valencia claims Snapple is guilty of unjust enrichment and fraud and of violating the Magnuson-Moss Warranty Act, New York General Business Law, and several state consumer fraud acts. 

Plaintiff is demanding a jury trial and requesting an award of monetary, statutory, and/or punitive damages for herself and all class members. 

A separate class action lawsuit was filed against Snapple in January 2022 by a consumer claiming the company misled them by selling diet peach tea powdered drink mix that was allegedly mislabeled as only having natural flavors.
