Zostavax causes shingles vaccine reactionAnother plaintiff has accused the manufacturer of the Zostavax vaccine of failing to keep consumers informed about the possible risks. The shingles vaccine reaction lawsuit claims that painful side effects emerged shortly after the receipt of the shingles vaccine.

Plaintiff Milovan S. has filed this latest shingles vaccine reaction lawsuit filed against Merck, the manufacturer of the Zostavax shingles vaccine. Many different patients who thought they were at risk of developing shingles underwent the procedure of getting the Zostavax shot.

Unfortunately, however, many of these patients experienced an adverse shingles vaccine reaction. Many of these patients have chosen to take legal action because of their shingles vaccine reaction.

The plaintiff in this shingles vaccine lawsuit is representing his wife, Delia, who is the injured party. She received the Zostavax vaccine on Oct. 31st, 2016, according to their shingles vaccine reaction lawsuit.

The shingles claim argues that Delia took the vaccine for the purpose of preventing shingles. However, as outlined in the shingles vaccine reaction lawsuit, shortly after obtaining the shot, Delia suffered occlusion of the middle cerebral artery, an ischemic stroke, myocardial infarction, and respirational pneumonia with sepsis.

Delia had to undergo multiple hospitalizations as a result of these injuries. This has led to physical limitations that were not present prior to receiving the Zostavax vaccine.

The lawsuit alleges that the shingles vaccine reaction in this particular patient was so severe that it left life changing injuries for the patient which dramatically altered her life. Milovan, however, says Delia never received appropriate warnings in advance about these risks, so was not given the opportunity to avoid these severe and permanent personal injuries.

Drug Manufacturer Responsibilities

The shingles vaccine lawsuit points out that the manufacturer, Merck, had a responsibility to exercise reasonable care in the research, manufacture, advertisement, design, packaging, promotion, and distribution of Zostavax. This includes the responsibility to take all reasonable steps necessary to sell a product that is not defective or unreasonably dangerous to consumers.

However, as alleged in their shingles vaccine reaction lawsuit, Merck failed to exercise appropriate care with regard to its product and left consumers at risk of developing significant and life changing consequences, like severe shingles or even eye damage.

An adverse shingles vaccine reaction can include a variety of different types of medical conditions as well as the development of shingles itself. The development of shingles or suffering side effects following the receipt of any vaccine can compromise a patient’s overall health and lead to additional cost and injuries.

A growing number of people who have experienced negative side effects from Zostavax have chosen to take legal action against Merck in an effort to recover compensation for injuries sustained.

Delia and Milovan’s  shingles vaccine reaction lawsuit says that Delia has sustained medical expenses, the loss of earning potential and other economic and non-economic damages.
