Disney Dream Key false advertising class action lawsuit overview: 

  • Who: Jenale Nielsen filed a class action lawsuit against Walt Disney Parks and Resorts U.S. Inc. 
  • Why: Nielsen claims Disney falsely advertises its Dream Key passes as containing no “block out dates.”
  • Where: The class action lawsuit was filed in the Superior Court for the State of California.

Walt Disney Parks and Resorts falsely advertises that consumers who purchase a Dream Key pass can enter the Disneyland theme parks without any “block out dates,” a new class action lawsuit alleges. 

Plaintiff Jenale Nielsen claims Dream Key holders are, in fact, subject to a number of dates where they are unable to enter the park with the pass despite paying more for the privilege of not having to deal with block out dates. 

Nielsen claims Disney profited from selling the passes “falsely, “deceptively and unlawfully.” 

Nielsen says she paid $1,399 for the Dream Key pass, which is part of Disney’s Magic Key program that allows holders to enter the theme parks a number of days each year, among other perks. 

The Dream Key pass is advertised as having no block out dates, unlike the Enchant Key and Believe Key, which cost less but have more restrictions. 

Disney blocked out days so they were only available for new purchases, plaintiff claims

Nielsen, who says she bought the pass in October, argues that, despite being assured she would be able to make a reservation to go any day of the year with the Dream Key pass, she immediately discovered many dates in November had already been blocked out. 

Despite blocking out the dates, Disney was not at capacity for the days it had blocked out, Nielsen claims, arguing instead the company simply didn’t want to make the days available for Dream Key holders. 

“The problem was not that Disney had reached its capacity and therefore could not provide reservations to its Dream Key pass holders, the problem was that Disney had decided to block out reservations so that they were only available to new purchases and were not available to Dream Key pass holders,” the class action lawsuit states. 

Nielsen claims Disney is in violation of California’s Consumers Legal Remedies Act, False Advertising Law and Unfair Competition Law

The plaintiff is demanding a jury trial and requesting relief in the form of restitution, along with actual and statutory damages for herself and all class members.

The plaintiff wants to represent a nationwide class of consumers who purchased a Dream Key pass from Disney within the past four years. 

In October, Disney reached an agreement with actress Scarlett Johansson to resolve claims it violated her contract by releasing the film Black Widow on its streaming service instead of exclusively in theaters.

    My wife and I have been blocked out of at least 20 days. We were under the impression that we would be able to go when we wanted only to find out that disney would block days and sell tickets. That is not fair my kids and family missed out on many times that we should have been able to go.

    Same here! Purchased Dream Key passes but have had to purchase daily tickets to get into the park. Just ridiculous!

    Yes, it has now happened 3 times where I am going with family or friends that have bought a regular day ticket or a hopper and they have reservations available for those ticket holders but not my Dream Key annual pass that isn’t supposed to have block out days! I have emailed Disneyland twice about this and both messages have been ignored. I cannot believe how bad Disney has gotten. I want to join the class action.

    Yes!!! Add me Please! My email is sfarrell1@peoplepc.com. Name is Stephanie Farrell – I live in Houston, Texas. I am a long time Disney pass holder. Trying to plan a trip from out of state is exceptionally difficult when you have to plan out flights, hotels, car, etc. I have always had this past because I also work in California and I’m there on a routine basis. I never know what day I can or cannot attend. Sometimes, I enter the park just to do a little shopping and never ride a ride. It’s very upsetting to me that I pay for this daily privilege, and I cannot enter because of the stupid reservation system. But at the same time I can buy a ticket at the ticket booth and enter with no problem. Deceptive greedy practices at its best. Disney is just trying to control their most loyal base – pass-holders. I’m losing my love for Disney very fast. Please contact me.

    Yes this is exactly what happened. Disney allows non pass holders to buy tickets when pass holders are blocked from those same dates. This is mainly since they make more money from ticket holders and not pass holders
