Timeshare Rental Company Robocall Class Action Lawsuit Overview:

  • Who: Timeshare rental company, Vacation Experts has been hit with a TCPA class action lawsuit.
  • What: Consumers allege the company violated their privacy and harassed them with repeated robocalls.
  • Where: The lawsuit seeks to represent consumers nationwide.

Timeshare rental company, Vacation Experts International, LLC, violated consumers’ privacy and harassed them with repeated robocalls, violating the Telephone Consumer Protection Act (TCPA), a class action lawsuit alleges.

The lawsuit was filed in Connecticut by lead Plaintiff Leonel Costa, who says that Vacation Experts repeatedly called him to market its timeshare rental services using pre-recorded telemarketing calls “in plain violation of the Telephone Consumer Protection Act.”

The TCPA generally prohibits robocalls to cell phones and home phones.

Costa and other consumers have been harmed by the company “because their privacy has been violated, they were annoyed and harassed, and, in some instances, they were charged for incoming calls.”

“Plaintiff and the Class Members were also harmed by use of their telephone power and network bandwidth and the intrusion on their telephone that occupied it from receiving legitimate communications,” the claim alleges.

Timeshare Rental Co Peppers Consumer With Robocalls

Costa says that he received at least fifteen telemarketing calls from the company between February and December 2019. Then, in 2020, he was called again in January and October. In 2021, he was called again between January and April.

The calls all solicited Costa, who says he had never done business with the company,  to Vacation Experts timeshare rental services, the claim explains, adding that he had never given his prior express written consent to receive the calls.

The class action says that Vacation Experts calling conduct has been widespread, and that The Better Business Bureau has received several complaints about the company.

Costa wants to represent anyone in the US who has received a robocall from Vacation Experts. He is suing for violations of the TCPA and seeks certification of the Class, injunctive relief, $500 for each violation of the TCPA and $1,500 for each knowing or willful violation, and a jury trial.

Recently, a $6.4 million deal was reached in a Federal Trade Commission (FTC) case against five Florida-based companies and two executives over the millions of illegal robocalls made to consumers falsely advertising “free cruises.”

    I’ve received several robo calls also spoke to live people and told them I don’t own nor have I ever had a timeshare and they’re very persistent, asking me for my personal info and if I’m willing to sell mine. They’re relentless!

      I get so many robocalls and spam calls it’s not even funny. Being on the Do Not Call List does not seem to help. I have been on the do-not-call list since 2010 and they still call. I got a call about 2 years ago on my home phone from a timeshare company that my ex-husband must have signed up for and supposedly co-signed my name because they told me I owed them money and I said look whatever he did was fraudulent and they still call and I said look we have been divorced now since 2006 and I don’t know anything about a timeshare and he’s been remarried twice since then. They still insist on calling and I told them the last time if they called me again that I would personally locate where they were at which is not hard to do and I would serve them with a notice to go to court for too many phone calls and harassment. I get calls from everywhere and Robo calls from dealerships that I’ve never even purchased anything from and all these extended warranty junk. Unfortunately I ended up deleting all the messages but I did do all the numbers with notes about what they were and who they were from or what they said they were from. And I blocked every single one of them. I don’t know if this will help as I have a long list of numbers.
