
Teleflora text message class action lawsuit overview:

Floral wire service company Teleflora engaged in an unsolicited text message marketing campaign that included numbers listed on the National Do Not Call Registry, a new class action lawsuit alleges.
Plaintiff Randi Duhigg claims Teleflora violated the law by allegedly contacting individuals with numbers on the National Do Not Call Registry and failing to get required consent from others.
Duhigg argues Teleflora’s alleged misconduct violates the Telephone Consumer Protection Act (TCPA) and the Florida Telephone Solicitation Act and claims it caused her and other class members annoyance.
Teleflora also allegedly violated the statutory rights of the individuals it allegedly contacted; caused trespass, nuisance, invasion of privacy and intrusion upon seclusion; and took up space on their devices, the Teleflora class action alleges.
Teleflora used automatic telephone dialing system, class action says
Duhigg claims Teleflora also allegedly sent the unsolicited marketing text messages using an automatic telephone dialing system without first receiving the prior express consent of the text messages recipients.
She demands a jury trial and requests injunctive relief along with an award of statutory damages for herself and all class members.
Teleflora has since requested that the class action lawsuit be removed from the 18th Judicial Circuit Court in and for Seminole County, Florida, to the United States District Court for the Middle District of Florida.
In related TCPA news, Citrix agreed to pay $2.75 million to resolve similar claims that the company violated the TCPA by allegedly contacting consumers using robocalls without first obtaining their consent.
The class action settlement benefits consumers who either received one or more phone calls from Citrix, two or more calls to a number on the National Do Not Call Registry and/or received one or more calls after having asked the company to stop.
