Office Depot class action lawsuit overview:

A new Office Depot class action lawsuit alleges the retailer violates the Telephone Consumer Protection Act by sending unsolicited text messages after consumers opt out of the communications.

Plaintiff Briana Glasel claims she has continued to receive numerous Office Depot text messages even though she asked the company to stop contacting her on at least six occasions.

“All stop requests were acknowledged but ignored by [Office Depot],” Glasel says in the Office Depot class action.

The TCPA requires telemarketers to honor do-not-call requests within 30 days of the request, the lawsuit explains.

Glasel says her phone number has been listed on the National Do Not Call Registry since May 3, 2018. She claims that despite this, Office Depot initiated text message communications with her in violation of the TCPA.

Thousands may qualify as members of Office Depot class action, plaintiff says

Glasel seeks to represent two proposed classes of consumers who received unwanted Office Depot text messages. The first proposed class includes consumers who were sent Office Depot text messages about the company’s products or services after opting out of the communications in the last four years.

The second proposed class includes consumers whose phone numbers were listed on the National Do Not Call Registry for at least 30 days before receiving unsolicited Office Depot text messages about its goods or services, and who did not make any purchases or other transactions with the company 18 months before receiving the first communication.

Glasel believes thousands of U.S. consumers may qualify as class members in the Office Depot text messages lawsuit.

She is seeking statutory damages as applicable under the TCPA on behalf of herself and other eligible class members and an injunction to prevent Office Depot from making further allegedly unlawful telemarketing calls.

Temu was recently hit with a similar TCPA class action lawsuit for allegedly sending unwanted telemarketing text messages to consumers with numbers listed on the National Do Not Call Registry.
