Advancing technology has made it easier and easier for telemarketers to reach potential customers. This means that consumers face an increasing number of robocalls, spam texts, and voicemail solicitations for products, services and more.

You may be one of the many people bothered on a daily basis by spam calls. You may have tried various ways of curbing the onslaught of telemarketers. However, most people discover that their best efforts to prevent spam calls are ineffective.

Why is the Do Not Call List Not Working?

If you have registered your number with the National Do Not Call Registry and are still getting calls, you may wonder why this is the case.

The Telephone Consumer Protection Act prohibits businesses from sending telemarketing calls, spam texts, and voice mails to individuals that have not given prior, express consent to be contacted. It is also illegal for businesses to contact numbers on the National Do Not Call Registry. 

Unfortunately, not all types of unwanted calls are prohibited, even to a number that’s on the Do Not Call Registry. Norton.com explains that charities, political candidates, survey companies, and debt collectors can still make calls to numbers on the list.

So even though you may feel like you’re having problems with the Do Not Call List not working, you may just be getting annoying calls from parties that are exempt from the list’s restrictions. For the most part,  the National Do Not Call List works only for sales calls.

Why am I Getting Sales Calls if my Number is on the Do Not Call List?

You may be getting sales calls from companies with whom you recently did business. During business transactions, many businesses may request permission to contact you in the future. You may not have realized it, but you may have unknowingly given a business permission to contact you. This may be why you are getting annoying calls from a particular business.

The good news is that you can still ask a business to stop contacting you, and once you make that request, they are legally required to stop.

Why do Businesses Violate the Law and Call Numbers on the Do Not Call List?

The Telephone Consumer Protection Act prohibits businesses from sending telemarketing calls, texts, and voice mails to individuals that have not given prior, express consent to be contacted. Unfortunately, many businesses try to dodge the law’s requirements, or violate the TCPA’s requirements altogether.

If you still have problems with the Do Not Call List not working, it may simply be because businesses are taking their chances and violating the law in the hopes of attracting potential customers. Some consumers may be responsive to sales pitches and end up making a purchase from a business that has contacted them unlawfully. 

Businesses who violate the TCPA face fines if found to have called or texted a consumer without consent. However, many consumers do not take legal action against telemarketers. Or the profits a business might make may exceed the fines that they would pay, so these organizations decide to take the risk and violate the TCPA.

    I get these calls all the time!! They are switching numbers so that the number shown on the caller ID is not the number they are actually calling from. I am trying to record as much as I can of the robo-call message, but since it starts as soon as the answering message of my voice-mail starts I only get the last part of the message. I have 6-8 calls per week or more.
