Home Depot Faces Class Action for Incessant Advertising Texts, Calls

Home Depot Advertising Texts Class Action Lawsuit Overview:

• Who: A Texas resident filed a class action lawsuit against Home Depot.
• Why: The resident continues to receive advertising texts and calls from Home Depot after attempting to opt out.

A Home Depot customer is suing the home improvement retailer for continuing to send advertising texts and calls even after the customer followed instructions to opt out on several occasions.

The lead plaintiff, Melissa Carson, allegedly continues to receive Home Depot advertising text messages, despite many “STOP” replies which are supposed to end the texts. Carson seeks to represent an Internal Do Not Call Class which includes anyone in the United States who has had a similar experience with Home Depot within four years prior to Sept. 7, 2021.

The class action lawsuit alleges that Home Depot’s actions violate consumer protection laws and cause Carson and other members of the Class harm, including “invasion of privacy, aggravation, annoyance, and wasted time.”

Home Depot Advertising Texts ‘Harassment’ and ‘Disruption’

The class action lawsuit claims that Home Depot’s unceasing texts and calls indicate the company’s failure to “implement a written policy for maintaining a do-not-call list” and train its telemarketing employees on the existence and use of the list. 

Unstoppable Home Depot advertising texts and calls result in “harassment, aggravation, and disruption of the daily life of thousands of individuals,” says the class action lawsuit.  

Carson and the class seek an order declaring that Home Depot’s actions violate consumer protection laws, payment of statutory damages, and requirements for Home Depot to cease calls listed on the National Do Not Call Registry, honor opt-out requests, and maintain an internal Do Not Call list. 

The retailer faces another class action filed earlier this year alleging The Home Depot uses software to monitor and record exactly what consumers are doing on its website, as though it were standing over a customer’s shoulder.
