CVS class action lawsuit overview:

  • Who: A consumer filed a class action lawsuit against CVS Health Corp.
  • Why: The plaintiff claims CVS violated the Telephone Consumer Protection Act (TCPA) by sending unwanted telemarketing text messages to numbers on the National Do Not Call Registry.
  • Where: The CVS text spam class action lawsuit was filed in Georgia federal court. A separate class action lawsuit filed in Pennsylvania accuses CVS of conspiring with drug manufacturers to keep lower-cost generic drugs out of reach for SilverScript Medicare Part D beneficiaries.

A new class action lawsuit alleges CVS Health Corp. violated the Telephone Consumer Protection Act by sending unwanted telemarketing text messages to individuals whose phone numbers are on the National Do Not Call Registry. 

Plaintiff Robert Lewis Jr. claims CVS sent him five telemarketing text messages from Jan. 30 to March 27 despite his phone number being listed on the National Do Not Call Registry.

Lewis argues that he never requested information or promotional materials from CVS, and that the receipt of the messages constituted “an invasion of privacy, an intrusion into his life and a private nuisance.”

Lewis wants to represent a nationwide class of consumers who did not give their number to CVS but received more than one voice or text message promoting the company’s goods or services within a year, and whose number was registered for at least 31 days before they received at least two voice or text messages in a year within the last four years.

CVS class action lawsuit claims company violated TCPA

Lewis argues CVS violated the TCPA, which he claims provides that telephone solicitations cannot be initiated with residential telephone subscribers whose numbers are on the National Do Not Call Registry. He claims the same regulation extends to wireless telephone numbers.

Lewis is seeking treble damages, pre- and post-judgment interest, attorney fees and costs. He is also asking the court to enjoin CVS from continuing its alleged violative behavior.
