Choice Health TCPA $7M class action settlement

Choice Health agreed to a $7 million class action lawsuit settlement to resolve claims it violated the federal Telephone Consumer Protection Act (TCPA) with unsolicited phone calls.

The settlement benefits individuals who received two calls from Choice Health LLC, or from Digital Media Solutions LLC on Choice Health’s behalf, to a number registered on the National Do Not Call Registry within a 12-month period.

Plaintiffs in the class action lawsuit claim that Choice Health violated the TCPA by making unsolicited calls to numbers on the National Do Not Call registry. According to the TCPA class action lawsuit, Choice Health failed to get consumer consent before placing these calls.

Choice Health Insurance is a health care insurance provider.

The company agreed to a $7 million settlement to resolve the TCPA class action lawsuit.

Under the terms of the settlement, class members can receive an equal share of the net settlement fund. Actual payments will vary depending on the number of valid claim forms filed, but each class member is estimated to receive up to $33.79.

The deadline for exclusion and objection is May 20, 2024.

The final approval hearing for the settlement is scheduled for July 9, 2024.

In order to receive a settlement payment, class members must submit a valid claim form by May 20, 2024.
