Allstate telemarketing class action lawsuit overview:

Allstate violates the law by allegedly sending unsolicited telemarketing calls to numbers listed on the National Do Not Call Registry as well as ones that are prerecorded, a new class action lawsuit alleges.
Plaintiffs Joseph Bond, Barbara Durant, Tonia Jewell-Vines and William Kroll claim Allstate is violating the Telephone Consumer Protection Act (TCPA) with calls placed on its behalf by insurance agents across the country.
The plaintiffs argue Allstate is responsible for the actions of agents who place calls on its behalf, as it is allegedly able to change at any time the standards callers must follow.
“At all relevant times, Allstate failed to maintain adequate policies, procedures, and training to ensure that it did not place an unlawful number of calls to numbers registered on the national do-not-call registry,” the Allstate class action states.
The plaintiffs want to represent a nationwide Prerecorded Call Class and Do-Not-Call Class of consumers who were contacted by Allstate with an unsolicited and unlawful telemarketing call within the last four years.
Allstate ‘knowingly accepted’ benefits of illegal telemarketing calls, class action says
Bond, Durant, Jewell-Vines, and Kroll claim Allstate profits off illegal telemarketing calls by sharing a portion of the premiums earned as a result of the sales the calls generate.
“Allstate knowingly accepted the benefits of the illegal telemarketing calls, both in the form of advertising benefits that Allstate obtained during the calls themselves and in collection of premium payments resulting from any sales made from those calls,” the Allstate class action states.
The plaintiffs are demanding a jury trial and requesting declaratory and injunctive relief along with an award of statutory damages for themselves and all class members.
Allstate agreed to pay $4.5 million last year to resolve a separate class action lawsuit accusing the insurer of violating the TCPA by allegedly placing unlawful and unsolicited telemarketing calls.

Yes, I’ve received unsolicited calls from Allstate agents repeatedly. I’ve told them no thank you and to remove me me from their list to no avail.
I have gotten calls even after telling them I am not interested and to put me on the do not call list. They have even gone as far as calling my minor child’s phone because it’s attached to mine. Add me to the list.
I got calls from Allstate trying to sell me mortgage insurance last year. They kept calling even after I told them I don’t even have a mortgage! My home number has been on the national do not call list since the do not call list was first created!
