Fingerhut has agreed to pay $5.25 million to resolve claims that it violated federal law by sending unsolicited text messages to consumers.
The settlement includes all persons who were sent a text message from or on behalf of Fingerhut where the number was coded by Fingerhut as a “wrong party” on an outbound call between March 14, 2012 and Oct. 15, 2018.
Plaintiff Elizabeth Busch filed her class action lawsuit against Fingerhut in March 2016, claiming that the company sent unlawful text messages to consumers. Busch claims that Fingerhut locates new numbers through skip tracing methods or through number trapping.
Busch claimed that the text messages from Fingerhut violated the federal Telephone Consumer Protection Act (TCPA). The TCPA protects consumers from harassing telemarketing practices including unsolicited calls, text messages, and faxes.
Fingerhut has agreed to pay $5.25 million to resolve claims against them. Although the company chose to resolve the claims, they do not admit any wrongdoing or liability through the settlement.
There isn’t an estimate for how much the settlement payments will be. Each Class Member will receive an equal share of the net settlement fund after the deduction of fees and costs, so the amount will depend on how many claims are filed.
Class Members need to file a valid claim by Aug. 29, 2019 if they wish to receive payment from the settlement.
The deadline for exclusion and objection is July 30, 2019. The final approval hearing is scheduled for Oct. 8, 2019.

I received a check dated 12/12/2019 for 81.73
I’ve been getting phone calls from Fingerhut and I told him to stop calling me and they keep calling me they messed up my credit they’ve done all kinds of crazy stuff to me I would like to talk to somebody I have record of all the payments that I made for years at least people are still harassing me
