A $1.15 million Compass Bank class action settlement has been reached, resolving claims that the bank placed survey phone calls to non-customers in violation of federal law.

Class Members include those who received a Compass Bank survey phone call on their cell phone either from the bank, or from MSR Group calling on behalf of Compass, between Dec. 14, 2012 and Feb. 8, 2019.

Plaintiff Robert Hossfeld accused Compass Bank of making unsolicited phone survey calls to consumers’ cell phones in violation of the Telephone Consumer Protection Act.

According to the Compass Bank class action lawsuit, consumers, some of whom never had any contact with the bank, were subject to these unwanted phone calls.

Under the Telephone Consumer Protection Act, TCPA, businesses are prohibited from calling consumers with advertising messages without prior express consent. Companies are also barred from using automatic dialing systems or prerecorded voices.

The Compass Bank phone call survey class action lawsuit alleged that the bank, as well as a third party marketing company, MSR Group, both called without permission and used an automatic dialing system.

Further, the bank used a prerecorded message, said the plaintiffs.

Under the terms of the Compass Bank class action settlement, Class Members are expected to receive between $100 and $350.

To make a claim, Class Members must provide a Notice ID and pin provided on the Notice.

Class Members who did not receive a Notice can mail a Claim Form with the cell phone number that received the Compass Bank phone call survey.

The deadline to opt out or object to the settlement is May 9, 2019.

Who’s Eligible

Class Members include all non-customers of Compass Bank who received a Compass Bank phone survey call between Dec. 14, 2012 and Feb. 8, 2019.

$100 to $350 (estimated range)

    I get these calls from all these 916 numbers, I block them but I doesn’t help, they call from a different 916 number, it goes on all day. I have come to the point of just answering the the call and not saying anything, just listening to them talk, so that I call see who is calling this time. What can I do about this. I have told many of them to stop calling. It is very frustrating.
