American Power & Gas recently agreed to pay $6 million to resolve claims that the company violated the Telephone Consumer Protection Act by placing automated robocalls to consumers.
If you received an unwanted phone call from American Power & Gas LLC and/or Consumer Sales Solutions LLC through ViciDial technology between June 14, 2013 and Aug. 31, 2018, you could get an estimated $100 from this settlement.
Plaintiff Karen Evans filed the American Power & Gas class action lawsuit in 2017 over claims that the company placed illegal, automated robocalls without the consent of consumers.
According to the AP&G class action lawsuit, these unwanted calls were in violation of the Telephone Consumer Protection Act (TCPA).
The TCPA is a federal law which was passed to protect consumers from harassing communications through phone calls, text messages, and faxes.
A variety of behaviors are prohibited under the law including: placing robocalls; sending unsolicited text messages; failing to provide an opt out option; calling numbers on the National Do Not Call Registry; and more.
Evans says she received a telemarketing call from American Power & Gas in which a representative urged her to get a recent copy of her gas and electric bill so the agent could inform her how she could reduce her energy costs by changing providers.
The American Power & Gas class action states that Evans was not interest in switching providers and was annoyed by the telemarketing call.
The plaintiff says others have complained of AP&G’s telemarketing calls prompting her to file a class action lawsuit. Evans claims that she and other call recipients were injured by these robocalls.
“They were temporarily deprived of legitimate use of their phones because the phone line was tied up, they were charged for the calls, and their privacy was improperly invaded,” the American Power & Gas class action lawsuit alleges.
American Power & Gas and Consumer Sales Solutions deny any unlawful actions and violations of TCPA or other laws. Instead, the settlement is reportedly poised to resolve the TCPA claims without the risks and costs associated with continuing litigation.
Class Members may be eligible for an estimated payment of $100 if they file a valid claim before April 2, 2019. The settlement will also provide up to $2 million in attorneys’ fees, litigation costs of up to $37,059.65, and a plaintiff service award of up to $10,000.
Objections and opt out requests must also be made by April 2, 2019. The final approval hearing is scheduled for May 21, 2019.

Individuals who received unsolicited robocalls placed by American Power & Gas LLC and/or Consumer Sales Solutions LLC through ViciDial technology between June 14, 2013 and Aug. 31, 2018.

Why not include landline telephone numbers? Consumer Sales Solutions harassed me every day for at least a year, even though I repeatedly told them I was not interested!
