Sunrun solar panels made unwanted phone calls to consumers

Consumers were able to secure a $5.5 million settlement in a Sunrun Solar robocalls class action lawsuit.

If you received a telemarketing call advertising Sunrun or Clean Energy Experts between Nov. 20, 2011 and Aug. 21, 2018, without providing prior express consent, you could get money from this class action settlement.

To be eligible, consumers must have either received the call on their cell phone or have been listed on the Do Not Call Registry.

A class action lawsuit states that Sunrun Solar, along with Clean Energy Experts LLC, made automated, prerecorded calls to consumers touting their solar energy products.

Plaintiff Lynn Slovin claimed that these calls were made in violation of the Telephone Consumer Protection Act.

The TCPA prohibits companies from making telemarketing calls without the prior express consent of the consumer. The law also prohibits the use of automatic dialing systems and prerecorded messages — both of which Sunrun Solar was accused of using.

The TCPA also set up the Do Not Call Registry. Consumers can ask for their number to be included on the Do Not Call Registry, and companies are prohibited from contacting numbers on the list under the law.

The Sunrun class action lawsuit alleges that the robocalls were a nuisance that used up valuable time, energy and phone data.

“By making these robocalls and ignoring the national Do-Not-Call registry, [Sunrun] caused [the class] actual harm, including the aggravation, nuisance, and invasion of privacy that results from the receipt of unsolicited and harassing telephone calls,” the Sunrun class action lawsuit claims.

Sunrun Solar agreed to pay $5.5 million to end the class action lawsuit. Under the terms of the Sunrun Solar class action settlement, Class Members can make a claim for a portion of the settlement amount estimated to be between $100 and $250.

In addition, the solar services company has agreed to comply with monitoring over the next four years that will ensure they are not using robocalls to advertise or otherwise violate consumer protection mandates.

“Sunrun/CEE have denied and continue to deny each and every material factual allegation and all claims asserted against them in the Action. Nothing in this Settlement Agreement will constitute an admission of wrongdoing or liability, or of the truth of any allegations in the Action,” the Sunrun settlement states.

Class Members may submit a Claim Form online or via mail and must provide the phone number that received the Sunrun Solar robocalls.

The deadline for Class Members to object to or exclude themselves from the Sunrun Solar robocalls class action settlement is May 31, 2019.

Who’s Eligible

Class Members include those who “received from or on behalf of Sunrun and/or Clean Energy Experts, or from a third party generating leads for Sunrun and/or Clean Energy Experts: (1) one or more calls on their cellphones, or (2) at least two telemarketing calls during any 12-month period where their phone numbers appeared on a National or State Do Not Call Registry or Sunrun’s and/or Clean Energy Experts’ Internal Do Not Call List more than 30 days before the calls,” between Nov. 20, 2011 and Aug. 31, 2018.

Potential Award

Between $100 – $250.

The $5.5 million settlement fund will be distributed equally to Class Members who file a valid claim after legal expenses have been paid. The actual amount each consumer receives is unknown at this time, but Class Counsel estimates the payout to be between $100 and $250.
