USAA hit with lawsuit over debt collection calls

A consumer in Georgia says he was peppered with debt collections calls from USAA Savings Bank that continued even after he asked them to stop.  

Plaintiff Henry Holmes is seeking thousands in damages for each and every debt collection call made by USAA in a lawsuit filed in Nevada federal court. Holmes says he received more than 125 calls from USAA between Feb. 11 and June 30 of last year over an alleged debt.  

Holmes claims that when he first began receiving the calls, he “unequivocally” revoked his consent for the Nevada-based company to call him, according to the lawsuit. In fact, Holmes says that he told USAA to send him all the information about the alleged debt in writing.  

Despite his request, Holmes claims that USAA continued to make debt collection calls. He allegedly sometimes received multiple calls per day, interrupting his work repairing medical equipment and stressing him out.  

“Defendant’s calls not only induced stress on Plaintiff, but also made Plaintiff anxious that his work would be affected in a negative manner due to the incessant calls to his cellular phone,” says the lawsuit.  

The lawsuit alleges that USAA violated a federal law meant to protect consumers from harassment from debt collectors and other telemarketing activity: the Telephone Consumer Protection Act (TCPA). The TCPA, made a law in 1991, requires companies making debt collection or marketing calls to obtain the express consent of consumers they are calling. The law also created the National Do Not Call Registry, which allows consumers to place phone numbers on a list that marketers are not supposed to use.  

In addition, the TCPA limits the use of automatic dialing systems and prerecorded messages. However, Holmes claims that USAA used both during its hundreds of debt collection calls to him.  

Violations of the TCPA can result in steep penalties of up to $1,500 per unsolicited call. The lawsuit demands USAA pay the fines based on the law, along with actual and punitive damages.
