Pizza Hut text messages class action lawsuit overview:

Pizza Hut sends unsolicited marketing text messages to consumers after they have attempted to opt out of receiving the solicitations, a new class action lawsuit alleges. 

Plaintiff Danuel Cortez claims Pizza Hut’s alleged failure to honor opt out requests shows it does not follow lawful telemarketing protocols nor provide its workers with proper training, in violation of the Telephone Consumer Protection Act (TCPA). 

Cortez argues he asked Pizza Hut to stop contacting him in April 2022, but that the restaurant chain sent him text messages in the May and June that followed. 

“Plaintiff attempted to opt-out of Defendant’s text message solicitations by responding, but Defendant continued to send its illegal text message,” the Pizza Hut class action states. 

Cortez wants to represent a nationwide class of consumers who were sent a promotional text message by Pizza Hut within the last four years after having requested that the company not contact them.

Cortez argues Pizza Hut’s alleged failure to stop sending unsolicited text messages “resulted in the invasion of privacy, harassment, aggravation, and disruption of the daily life of thousands of individuals.” 

“Defendant’s illegal acts caused Plaintiff and the Class members harm, including statutory damages, inconvenience, invasion of privacy, aggravation, annoyance, and violation of their statutory privacy rights,” the Pizza Hut class action states. 

Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of statutory damages for himself and all class members. 

A class action lawsuit was filed against Pizza Hut’s parent company Yum! Brands Inc. in April over claims the restaurant franchisor failed to adequately safeguard the personally identifiable information of job applicants and employees during a January 2023 data breach.

    Lending Tree does this also. If they get your phone number and / or email address they share it with realtor’s and you will get bombarded with calls, texts, and emails from lots of realtors, finance companies, etc. Asking them to stop does no good because you are on a shared list.
