Loan Depot phone calls class action lawsuit overview: 

  • Who: Zachary Sawicki filed a class action lawsuit against Loan Depot LLC. 
  • Why: Sawicki claims Loan Depot violates the law by sending unsolicited telemarketing calls and automated voice messages, including to numbers that are listed on the National Do-Not-Call Registry. 
  • Where: The class action lawsuit was filed in Florida federal court.    

Loan Depot LLC engaged in unlawful telemarketing practices by repeatedly placing unwanted solicitation calls and automated voice messages, including to numbers listed on the National Do-Not-Call Registry, a new class action lawsuit alleges. 

Plaintiff Zachary Sawicki claims Loan Depot, a national mortgage lender, placed “no less than five” solicitation calls to his telephone number, despite it being listed on the National Do Not Call Registry. 

Sawicki argues that, despite his requests to not receive anymore of the telemarketing calls and attempts to opt out, Loan Depot “continued pounding Plaintiff’s cellular phone number with solicitation calls.” 

“Despite opting out per Defendant’s instruction, Defendant continued placing solicitation calls to Plaintiff’s cellular phone number,” states the Loan Depot class action. 

Sawicki wants to represent a national Do-Not-Call Registry class who received a call placed by or on behalf of Loan Depot, and a nationwide class of individuals who answered a solicitation call from Loan Depot, each within the last four years. 

Also included in the Loan Depot class action is a nationwide class of individuals who received a pre-recorded message from Loan Depot or a caller acting on its behalf, and a Florida class of individuals who received a solicitation call from Loan Depot or a caller acting on its behalf. 

Loan Depot telemarketing calls are an invasion of privacy, nuisance, waste of time, says class action

Loan Depot’s alleged unlawful telemarketing practices have caused damages such as invasion of privacy, nuisance, waste of time, decreased productivity, and loss of concentration, among other things, the Loan Depot class action alleges. 

Sawicki claims Loan Depot is in violation of the Telephone Consumer Protection Act (TCPA) and the Florida Telephone Solicitation Act. He is demanding a jury trial and requesting an award of monetary and treble damages for himself and all class members. 

A number of similar class action lawsuits have been filed this year against companies accused of violating the TCPA through allegedly unlawful telemarketing practices, including Subway, Petland, and Shoe Carnival, among others.

    I have been on the DNC registry, I have spoken directly to the company multiple times about removing me from their system, and I have blocked all of the multiple numbers they have called me from. They still call me at least 3 times every single day. My phone notifies me of the blocked call every time. It is complete harassment and needs to be put to a stop!

    I keep getting calls from loan depot and I am on a do not call list. The call appears to be in my area with the area code however I’m sure how they get you to answer ( I did not I know better)

    Loan Depot calls me 3 to 5 times a day. I spoke with a Savannah and told her not to call. I told her I was going to report them. Then she told me I could get a loan. I told her this was harassment and to stop.
