Life360 app class action overview: 

  • Who: A Florida minor has filed a class action lawsuit against Life360.
  • Why: The plaintiff says the company quietly sold its users location data to third-party companies without their consent.
  • Where: The Life360 app class action was filed in a California federal court.

Life360 has surreptitiously and non-consensually sold “millions” of its users’ geolocations,  including that of children, for its own profit, a new class action lawsuit alleges. 

Plaintiff E.S.—a Florida minor—filed the class action lawsuit against Life360 Inc on Jan. 12 in a California federal court, alleging violations of state and federal consumer laws.

According to the lawsuit, Life360 has been a popular family safety app for years, marketed as a great way for parents to track their children’s movements using their cellphones. 

“However, unbeknownst to Life360’s users, the app has been selling data on childrens’ and families’ whereabouts to approximately a dozen data brokers who sell that data to virtually anyone who wants to buy it,” the lawsuit states.

“By selling data in this way, Defendant profits from the Plaintiff’s and class members’ data time and time again to countless third parties.”

Sale of location data puts users at risk, lawsuit alleges

The lawsuit states that the undisclosed sale of user data is not only unlawful but is also potentially dangerous, because it can provide malevolent actors with the tools needed to target particular members of society.

“The data sold by Defendant may be used to identify individual consumers and their visits to sensitive locations.”

One example is if the data is used to identify consumers who have visited an abortion clinic, or a certain place of worship, addiction recovery centers, or a domestic violence shelter.

Meanwhile, selling location data has become more and more central to the Defendant’s finances, the lawsuit alleges. 

In 2016, the company made $693,000 from selling data it collected. In 2020, the company made at least $16 million—nearly 20 percent of its revenue that year—from selling location data, the lawsuit states.

The plaintiff seeks to represent a class of United States residents whose data was sold by Life360 without their consent. 

He alleges violations of his privacy rights, state consumer protection and privacy statutes, and Section 5 of the FTC Act and seeks certification of the class action, damages, fees, costs and a jury trial. 

Meanwhile, a SpongeBob SquarePants-themed app will make changes to resolve allegations brought under the Children’s Online Privacy Protection Act (COPPA), it announced last year.
