Inflection Risk Solutions agreed to pay $4 million to resolve claims that included inaccurate criminal record information on background checks.
The settlement benefits two classes: the Deemed Misdemeanor Class and the Nationwide Inaccurate Offense Characterization Class.
The Deemed Misdemeanor Class is made up of consumers who had a consumer report published on them by Inflection Risk Solutions between Oct. 12, 2018, and July 13, 2021, and had a Minnesota criminal conviction with a stayed sentence where the conviction was deemed a misdemeanor but the consumer report indicated the offense was a felony and did not indicate the conviction was deemed a misdemeanor.
The Nationwide Inaccurate Offense Characterization Class includes consumers who had a consumer report published on them by Inflection Risk Solution between Oct. 12, 2018, and Sept. 29, 2021, where the report listed a criminal offense and characterized the offense as “offense class: violence” despite the description of the crime not involving a violent act against another person. A list of offenses covered by this criteria can be found on the settlement website.
Inflection Risk Solutions is a background-check company based in California. The company analyzes public records to develop reports on applicants and other entities.
According to a class action lawsuit, Inflection Risk Solutions violated the Fair Credit Reporting Act (FCRA) by including false information about criminal backgrounds. The company allegedly classified certain criminal convictions as felonies or violent offenses despite not qualifying for this label.
“Minnesota law provides that a criminal defendant who successfully completes probation without the imposition of a prison sentence will have his or her conviction deemed a misdemeanor notwithstanding that the conviction was originally deemed a felony,” the FCRA class action lawsuit notes.
The plaintiff in the case says he was denied use of the Airbnb app as a result of this inaccurate credit report.
Inflection Risk Solutions hasn’t admitted any wrongdoing but agreed to resolve these allegations with a $4 million class action settlement.
Under the terms of the settlement, class members can receive a cash payment based on their class status. Exact payment amounts will vary depending on the number of participating class members in each group.
The Deemed Misdemeanor Class will receive payments from $747,000 of the settlement fund. Members of the Deemed Misdemeanor Class can receive a cash payment estimated to be between $470 and $480.
The Nationwide Inaccurate Offense Characterization Class will receive payments from $3.253 million of the settlement fund. Members of the Nationwide Inaccurate Offense Characterization Class can receive a payment estimated to be between $70 and $95.
Class members can collect both types of payments if they are members of both classes. In order to collect both payments, class members meet the claim requirements for the Nationwide Inaccurate Offense Characterization Class.
The deadline for exclusion and objection is Oct. 28, 2022.
The final approval hearing for the Inflection Risk Solutions settlement is scheduled for Nov. 15, 2022.
In order to receive a settlement payment, class members must submit a valid claim form by Oct. 28, 2022.

I just found out that my credit report is bad and credit runied over solution my credit score with them 541 and my credit score is 705and 715 they have felony on my record from 10years a go blocked my credit and have me all over California and my SSN stolen IRS I had to prove I’m not drawing unemployment addresses all over world stopped my bank loans with wrong credit score and threats from them I use credit karma and they said I have all my address wrong and banks sent me email saying not approved from my report from them they ruined me on car insurance and rentals
