GameStop class action claims company shares customer data with Facebook

GameStop customer data class action lawsuit overview: 

• Who: Alejandro Aldana and Scott Gallie filed a class action lawsuit against GameStop Inc. 
• Why: Aldana and Gallie claim GameStop violates the Video Privacy Protection Act by sharing the personally identifiable information—including specific video game purchases—of their customers with Facebook without consent.
• Where: The class action lawsuit was filed in New York federal court. 

GameStop discloses the personally identifiable information of its customers—including what specific video games they purchased from the company—with Facebook without receiving their consent, a new class action lawsuit. 

Plaintiffs Alejandro Aldana and Scott Gallie claim GameStop is violating the Video Privacy Protection Act by knowingly sharing their customers personally identifiable information to Facebook. 

Aldana and Gallie claim GameStop integrates what is known as the Facebook Tracking Pixel into its website in order to track consumers’ purchases and activities.

“Through the Facebook Tracking Pixel’s code, these cookies combine the identifiers with the event data, allowing Facebook to know, among other things, what video game a user has purchased,” states the GameStop class action. 

GameStop accused of ‘surreptitiously’ transmitting customer’s personally identifiable information to Facebook 

GameStop used the Facebook Tracking Pixel to “surreptitiously” transmit Aldana and Gallie’s personally identifiable information—including specific video game purchases—to Facebook, the GameStop class action alleges. 

“​​When the Facebook Tracking Pixel captures an action, it sends a record to Facebook. Once this record is received, Facebook processes it, analyzes it, and assimilates it into datasets like the Core Audiences and Custom Audiences,” states the GameStop class action. 

Aldana and Gallie want to represent a nationwide Class of consumers who have purchased a video game from GameStop. 

Plaintiffs are demanding a jury trial and requesting declaratory and injunctive relief along with an award of statutory and punitive damages for themselves and all Class Members. 

A separate class action lawsuit was filed against GameStop in 2018 by a consumer claiming the company sold the information of its Game Informer magazine subscribers to third parties, including data mining and marketing companies.
