Consumers filed multiple class action lawsuits against companies over alleged unlawful data tracking. 

The class action lawsuits claim the companies engaged in unlawful wiretapping, sharing personal information and hidden trackers. 

Class action claims SaaS company illegally wiretapped CVS website  

A pair of consumers filed a class action lawsuit against Quantum Metric Inc. last month over claims the software solutions company illegally wiretapped the electronic communications of CVS website visitors. 

The class action lawsuit claims QM embedded a code into CVS’s website to secretly capture website visitors’ activity and collect their personally identifiable information, including prescription and over-the-counter medication activity. 

“QM’s software-as-a-service begins operating as soon as a user accesses the website,” the CVS website class action states. “Thus, users are not on notice of QM’s wiretapping nor do users provide their consent to the same.”

Delta Air Lines unlawfully shared customer info with Facebook, class action says

A pair of consumers filed a class action lawsuit against Delta Air Lines Inc. in April over claims the airline broke its contract with its customers by unlawfully sharing their personal information with Facebook parent Meta Platforms. 

The class action lawsuit claims Delta installed a tracking pixel on its website that disclosed the personal information of its customers, including departure dates and airports and travel classes and loyalty statuses, to Facebook.

“Defendant’s sharing of this personal and identifying information with Facebook is in breach of the conditions of carriage and incorporated privacy policy to which plaintiffs and class members agreed,” the Delta data privacy class action states. 

Class action claims TJX embedded hidden spy pixel trackers in marketing emails

A consumer filed a class action lawsuit against TJX Companies Inc. last month over claims the off-price retailer embedded hidden spy pixel trackers in marketing emails to collect sensitive identifying information from its customers.  

The class action lawsuit claims TJX, which operates retail chains TJ Maxx, Marshalls, Sierra, HomeGoods and Homesense, violates Arizona law by embedding the spy trackers without first obtaining consent from consumers. 

“These trackers, known as ‘spy pixels,’ enable companies to learn information about the email transfer, including when and where the email was opened,” the TJX emails class action states.

BuzzFeed installed trackers on visitors’ browsers without consent, class action claims 

A consumer filed a class action lawsuit against BuzzFeed Inc. in April over claims the company violates California law by installing trackers on the internet browsers of its website visitors without their consent. 

The class action lawsuit claims BuzzFeed violates the California Invasion of Privacy Act by getting neither prior consent nor a court order before installing and using trackers on its website visitors’ browsers. 

“At no time prior to the installation and use of the trackers on plaintiff’s and class members’ browsers, or prior to the use of the trackers, did defendant procure plaintiff’s and class members’ consent for such conduct,” the BuzzFeed class action states. 

GM, OnStar shared driver data with insurers without consent, class action says 

A pair of consumers filed a class action lawsuit against General Motors, OnStar, LexisNexis Risk Solutions and Verisk Analytics last month over claims the companies collected and shared vehicle owners’ data with insurers without consent

The class action lawsuit claims GM and OnStar sold the info to LexisNexis Risk Solutions and Verisk Analytics, who used it to create a risk score they then shared with insurance companies. 

“For the most part, drivers who were subjected to this unauthorized intrusion into their private data experienced a concomitant increase in their insurance premiums presumably based upon this private driver behavior data or telematics provided to LexisNexis and/or Verisk, thereby causing them damage,” the GM class action states. 

America’s Test Kitchen agrees to end claims it shared consumers’ personal info with Facebook without consent

America’s Test Kitchen recently agreed to a settlement to end claims the company disclosed the personal information of consumers to Facebook without consent. 

A class action lawsuit filed against the multimedia cooking resource company argued it violated the Video Privacy Protection Act by allegedly embedding the Meta Pixel on its website. 

The settlement will benefit a nationwide class of America’s Test Kitchen subscribers who either requested or obtained a video on the company’s website while having a Facebook account between July 13, 2020, and Feb. 14, 2024.
